Executives
of Oil ,Power & Telecom demonstrated in large numbers in front of
DPE's office in support of early implementation of second wage committee
recommendations. They also demanded some amendments in the wage
recommendations like open ended pay scales, uniform A+ categorization,25%
risk pay as part of basic, better pay fixation etc. were the main demands.
Executives from BSNL(members of SNEA(I), MTNL, NTPC, ONGC, BPCL, HPCL, IOC

Judicial scrutiny of arbitrary allocation of 2G spectrum
by DOT recently to about 121 applicants resulting in alleged loss of about
50,000 crores to the government has begun. Stand of the Association on the
issue of 2G spectrum allocation is getting vindicated.
Hon’bleHigh Court of Delhi has issued notices to the Union of India asking it to
explain as to what first come first serve policy for allocation of 2 G
recently allocated spectrum to about 121 applicants many of them real estate
developers on a price decided in 2001 for the entry of fourth operator
means. Delhi High Court has issued notices to the Union of India on a PIL
despite very stiff opposition from the government counsel and the counsels
representing the 121 applicants. The plea of the government as well as the
applicants that petition on a similar matter is pending in TDSAT did not cut
much ice since Delhi High Court never wanted the PIL to be drifted in a
different direction altogether.
It is extremely pertinent to mention here that this
Association was the only forum in BSNL to raise the issue from different
platforms regarding arbitrary allocation of 2G spectrum and consequent loss
of about 50,000 crores to the exchequer in a vociferous manner. This
Association raised fundamental questions about the allocation of spectrum in
a non transparent manner, completely ignoring the timely warnings from the
PMOs office, Finance Ministry and CVC. The issues raised by this Association
more than six months before are clearly contained in the PIL filed in Delhi high Court. How the
value of Swan and Unitech, having no expertise or infrastructure in
Telecom,, enormously swelled by selling part of their equity to foreign big
players and vested interests. Swan which obtained 2 G spectrum at a
throwaway price of 1651 crores is today valued at more than 8000 crores by
selling its 45% equity to Etisalat, a telecom company of UAE.
BSNL Management, under pressure from DOT, went a step ahead
in allowing Swan to share its infrastructure, including wireless, so as to
help it to start wireless operations in the Country. This was also very
strongly protested by us. This Association shall tirelessly and fearlessly
continue its struggle against all such telecom policies of the government
which are intended to help private companies at the cost of the exchequer
and the growth of the BSNL.
A) Meeting with GM(Pers):
We met Shri R.K.Mishra, GM(PERS.) BSNL CO
and discussed,
1.
Restoration of Seniority of 1966 Persons: In continuation with our
discussion on the subject we laid stress for early restoration of the same
in line with the Honorable Court's judgment . It was intimated that now the
total work relating to seniority has been transferred under AGM(DPC). He
said that necessary draft for restoration of 1966 person's seniority has
been prepared and put up. Management is also positive in this
direction.
2.
Delay in issuing transfer orders of STS officers who have already completed
their hard tenure: We stressed that nearly 10 STS officers have already
completed their hard tenure and their transfers are pending. It was assured
that the orders may be issued very shortly.
3.Preparation
of Gr.A RRs: It was intimated that draft of the same has already
prepared. Efforts are on to get it approved in next Board meeting.
4.DPC
from JTO to SDE under seniority cum fitness quota: We came to know that
necessary corrections from many circles have been received w.r.t Eligibility
List. The work relating to corrections is already on. The CRs and vigilance
clearance from circles will be called very shortly in a time bound
manner.
(B)Meeting with PGM(BW):
In line with persuasion on ACP, we asked about the fate of the file
which was put up for formation of Committee on issues relating to ACP. It
was informed that file has come back from GM(Est.)'s office with the remark
that terms of reference of the committee be made such that necessary
approval for formation of the committee can be accorded.
We
met Shri Anil Jain GM(BB) ,BSNL CO regarding issues relating to Broadband.
We were informed that BSNL is providing more than one lakh, twenty thousand
connections per month . He said that he is trying his level best to
increase the no. of BB connections. He is taking all the initiatives to
increase the BB density. In this direction he has tried to pass the

Stand of the Association on
Retrospective Seniority fixation of TES Gr B officers against competitive
quota: DOT gave retrospective
seniority to 270 TES Gr B against competitive quota in the year 2001 on the
basis of what we gathered was Judgment of CAT Bangalore. In fact,
retrospective seniority to competitive quota was given prior to 2001 also.
On challenge, this retrospective seniority of 270 SDES was set aside by CAT
Madras against which DOT filed writ petition in Chennai High Court in 2001.
Chennai High Court set aside the writ petitions of DOT in the year 2008,
upholding the Judgment of Chennai CAT delivered in 2001. When the Judgment
of Chennai High Court was challenged in Supreme Court, it directed DOT to
maintain status quo. The case is now pending in Supreme Court where it is
expected to come up for final hearing shortly. In the meanwhile, DOT
published provisional seniority list of about 147 TES Gr B officers having
appeared in the qualifying cum competitive examinations in the years 2000
and 2003 according to the directions of Ernakulan High Court, extending them
also the principle of retrospective seniority on the lines of 270 SDEs in
2001.
Immediately after the provisional list was issued in
respect of 147 SDEs, and Supreme Court directed DOT to maintain staus quo
with regard to Judgment of Chennai High Court, we had very close and
prolonged interactions with the concerned officers of DOT and pleaded with
them not to finalize the provisional seniority list of these 147 SDEs till
disposal of the case in Supreme Court. Our argument was that since these 147
SDEs have been given retrospective seniority by extending the principle of
270 SDES, and since retrospective seniority of 270 SDEs is under challenge
in Supreme Court which has directed maintaining of status quo, it would be
appropriate for DOT to wait for the final outcome of the case in Supreme
Court before finalizing the provisional seniority of 147 SDEs. The concerned
officers of DOT assured us of seeking comprehensive legal advice in the
matter before finalizing the provisional seniority of 147 SDEs. Accordingly,
the file containing the entire background of the case along with all the
relevant Court Judgments was sent to the legal advisor of DOT who is a Jt/Secy
level officer from ministry of law. Legal Advisor/DOT, we were informed,
suggested going ahead with finalization of the provisional seniority of 147
SDEs, and final seniority list of these 147 SDEs giving them retrospective
seniority was issued by DOT. Out of these 147 SDEs, about 50 have been
promoted to adhoc STS very recently.
After all these developments, the Association has
decided to file an impleading application in Supreme Court where the whole
issue particularly the very basic principle of deciding whether
retrospective seniority fixation extended to 270 SDEs and subsequently to
147 SDEs is justified or not is going to be adjudicated. The Association has
already collected necessary documents and handed over the same to our lawyer
who shall very shortly be filing an impleading application in Supreme Court.
All the relevant facts in support of the adversely affected SDEs shall be
placed before the Supreme Court. We shall have to wait for the final outcome
of the case in the Supreme Court.
GS
and AGS, Com Khan, had very extensive and useful discussions with
GM(personnel) and DGM(personnel) on the vital issues of finalization of Gr A
RRs and recruitment of MTs. We impressed upon GM(Personnel) to fully
incorporate the decisions that have been taken in the joint committee of
BSNL Management and the United forum of executives. We reiterated the
crucial decisions taken by the Joint Committee like integration between
promotee STS and MTs at JAG in the ratio of 1;1, filling up of 50% STS posts
on regular basis by TES Gr B and equivalent and the remaining on adhoc,
regularization of existing adhoc STS to the extent of 50% of posts of STS,
granting of necessary relaxation to regular STS in terms of requisite
qualifying service for regular promotion to JAG etc. GM(Personnel) assured
that the memoranda of understanding between the United forum and BSNL
Management would be fully upheld and all the above cited important decisions
would be incorporated while finalizing Gr A RRs. Gr A RRs are expected to be
finalized very shortly, GM(Personnel) informed us.
Imparting of E2 to E3 training at RTTC/Hyderabad: Due to our strenuous efforts, Director(HRD) has approved RTTC/Hyderabad
for imparting E2 to E3 trainings. We are making hectic efforts to enlist
RTTC/Lucknow also for imparting E2 to E3 trainings.
3rd Circle Conference of J&K Circle at Jammu.
3rd Circle Conference of J&K Circle was held at
Jammu on 29th /30th Oct.,08. All the SSAs participated
in the conference. GS addressed the delegate session on the evening of 29th
Oct. 08 and in detail apprised the representative council of all the
developments at the Central level. An interactive session with the delegates
was quite absorbing and interesting.
A colourful open session on
the evening of 30th Oct.,08 was held at Hotel K.C.Residency which
was addressed by CGM/J&K, GMTD/Jammu, GM(A), GM(D) and GM(O), besides GS and
CS/J&K, Com Mahaldar. The issues of very tardy growth of mobile services in
J&K Circle due to complete indecisiveness of GM(Mobile)
were focused by CS in his address. GS in his address also underlined the
need of taking quick decisions and sought immediate and decisive
intervention of CGM/J&K to break the deadlock. CGM in his address assured
the house that immediate action to roll out phase 5.1 of mobile services
would be initiated.

GS, AGS, Com Khan, and
President/AIBSNL EA had a very extensive discussion with Director (HRD) on
the issues of restrictions proposed to be imposed in terms of educational
qualifications and age in so far as eligibility for appearing in the
internal competitive examination for recruitment of 25% MTs is concerned. We
conveyed in clear terms our opinion and cited the orders of DOP&T and
various judgments of Courts rejecting imposition of any condition on the
basis of age, educational qualification etc. for appearing in internal
competitive examination. However, the discussion remained inconclusive and
is expected to be held again in a couple of days. Streamlining the issues
related to TES Gr B seniority and creating an exclusive cell in personnel
section of BSNL to deal with very complex legal issues relating to TES Gr B
seniority were also discussed, since DOT, on our consistent persuasion, has
finally transferred the issue of TES Gr B seniority to BSNL in totality.
Director (HRD) assured that appropriate action in consultation with DDG(P)/BSNL
will very soon be initiated in this direction and the whole issue of TES Gr
B seniority will be dealt with on utmost priority.
Meeting with Director
(Operations/BSNL)
GS and AGS, Com Khan, met
Director(O) to request him to allow reimbursement of cost of purchase of
mobile sets prior to the issuing of the orders by BSNL Hqs since most of the
executives had already purchased mobile sets much earlier to issuing of the
orders. Director(O) assured that he would consider our request. The issues
arising on account of billing problems between BSNL and MTNL in respect of
Service connections for those officials of BSNL living in service area of
MTNL and vice versa was also discussed. Director(O) informed that he is in
close touch with the concerned officers of MTNL Management and is confident
of resolving this issue very shortly.
Meeting of the United forum
of executives of BSNL and MTNL:
All the Associations of
executives of BSNL and MTNL met to chalk out future organizational strategy
on the issue of ITS absorption. Very shortly, a comprehensive organizational
plan of action will be communicated to the field units to ensure that the
issue of absorption attains finality. Field units of SNEA(I) must start
gearing up to respond to the decisions of the united forum of executives of
BSNL and MTNL to effectively and successfully implement the hard decisions
that are expected to be taken just within a couple of days.

Oct.08: Meeting with Secy/DOT
GS, AGS, COM Khan, President/AIBSNL
EA and GS/AIBSNL EA met Secy/DOT to impress upon him to ensure that the
existing process of absorption of ITS Gr A reaches conclusive stage by the
stipulated date so that the prolonged uncertainty created in BSNL on
account of non resolution of absorption issue which is adversely affecting
its growth is put to an end. We also conveyed the serious concern and
anxiety of the grass root membership throughout the Country because of
continuing delay in ending the prevailing uncertainty, and very strongly
pleaded with Secy/DOT to take all possible steps towards completion of the
process by due date. Secy/DOT said that the Govt. is fully seized of the
matter and shall try to resolve the issue within decided time frame.
Discussion with DDG(E)/DOT
regarding deferred option to continue in CDA pay scale till date of
promotion/retirement:
We were informed by DDG(E) that for the first time he got
some positive indications from Jt Secy/DPE regarding resolution of the
issue. Secy/DPE informed DDG(E) to come for a discussion in the coming week
to resolve the issue finally. DDG(E) sounded quite optimistic about
resolution of the issue shortly and assured us that this week he along with
other concerned officers of DOT shall hold discussions with the Jt Secy/DPE
ti find out some way to resolve the issue.
Discussion with Jt DDDG(P)/BSNL
regarding posting of JTOs on promotion to SDEs against competitive quota:
GS and AGS,
Com Khan, held extensive discussion regarding the criterion to be adopted
for posting of JTOs on promotion to SDEs against competitive quota and
requested him to consider the requests of transfer of JTOs on promotion to
SDEs. Besides, other important inputs were given by us. Jt DDG(P) assured
that our suggestions would be given due consideration while finalizing
posting of JTOs on promotion.

MEETING
WITH JT/SECY( DOT) : GS, President/AIBSNL EA and GS/AIBSNL EA met Joint Secy/
DOT to know the latest staus on ITS absorption and the future strategy of
DOT to overcome any difficult situation that may arise in the event of mass
exodus of ITS officers to DOT. Jt Secy informed us that DOT is maintaining a
very close monitoring of the whole issue, taking into account all the
connected aspects of the absorption issue. On the issue of merger of BSNL
and MTNL, Jt Secy informed that some preliminary positive developments are
taking place on this issue.
MEETING WITH SECY/DPE: GS, President/AIBSNL EA and GS/AIBSNL EA met Secy/DPE to know
from him the actual and latest position relating to the 2nd pay
panel. Secy/DPE informed us that Committee of Secretaries (COSs) constituted
by the Govt. to sort out divergent views expressed by many ministries of
various CPSUs are treating the whole issue on utmost priority and already
have had extensive discussions quite recently. Further discussions of the
COSs to come to a consensus view are expected to be held very shortly. Secy/DPE
clearly and categorically stated that the Union Cabinet is going to take
final decision very shortly, not exceeding 30th Nov.,08. On the
issue of grant of Navratna status to BSNL, Secy/DPE said that a favourable
decision is expected very soon and that he is quite supportive on this
specific issue.
MEETING
WITH MEMBER (F)/DOT: GS, President/AIBSNL EA and GS/AIBSNL EA met Member (F)/DOT
to get first hand information about the status of 2nd pay panel
report of CPSUs since he represented DOT in the meeting of Committee of
Secretaries ( COSs) convened by the Cabinet Secretary recently to obtain the
views of the administrative ministries of CPSUs on the recommendations of
the 2nd pay panel. Member(F) informed us that things are shaping
and progressing in a positive direction and that he is confident that the
Govt. will take final decision on the report within a month’s time, after
COSs takes a final view on some of the contentious issues raised by various
administrative ministries of CPSUs. Many CPSUs through their administrative
ministries are understood to have expressed diverse views on some of the
important recommendations of the 2nd pay panel.
It is reliably learnt from Circle office Rajasthan that the writ petition
No. 4796/2007 filed by some JTOs stands disposed off today. The
sincere persuasion of SNEA(I) CHQ and Rajasthan circle yield the fruitful
result in paving away the hurdles in the issuance of TES.Grp-B promotion
order
under 25%LDCE quota.

Discussion
with Jt DDG(P):
GS and AGS, Com A.
Khan, met Jt DDG(P) and asked him to take expeditious action to restore back
the seniority of 1966 TES Gr B officers in accordance to the judgments of
Ernakulam and Delhi High Courts. He informed that action has already started
in this regard and assured that the issue would be treated on utmost
priority. Expediting JTO to TES Gr B DPC against seniority cum fitness quota
was also discussed.
Status
of issuing promotion orders against competitive quota:
With regard to stay granted by Hon’ble High Court of Rajasthan in respect of
competitive examination, Association is exploring the possibility of getting
impleaded in the Court case to get the stay vacated in Rajasthan High Court.
Discussion
with DDG (Trg):
The
issue of inadequacy of seats in ALTTC for imparting E2 to E3 training was
discussed and the instances of UP(E) and kerala circle were cited. We
informed DDG(TRG) that unless some urgent steps are taken by allowing RTTCs
also to impart E2 to E3 training, a very serious situation is definitely
going to occur in March ,09 when a very huge number of executives would be
waiting to get trained because of inadequacy of seats. We appeal to CSs
to find out the exact position in their respective Circles in this regard.
However, DDG(Trg) assured that he is already seized of the matter and is in
constant touch with the concerned authorities in ALTTC Ghaziabad.
Discussion
with DDG (E)/BSNL:
Constitution
of committee to sort out the ACP issue of Civil/Electrical etc. on the lines
suggested by us was discussed. We informed DDG(E) that the executives
working in Civil/Electrical etc are suffering very badly because of the
arbitrary order of Feb.,08, withdrawing the benefit of ACP scheme. DDG(E)
assured that action on the lines suggested by us recently i.e constitution
of committee is being considered to resolve the issue.
Discussion with DDG(EF),BSNL:
We
pointed out that there was considerable delay in issuing orders in
connection with AAO’s payscale. We were informed that file has just come
from SEA section and very soon we will send the file back and ensure
that the orders are issued at the earliest.
The issue of tax on perquisites for 2008-09
was also discussed and it was informed that the net financial implication is
being worked out and efforts are on to ensure that BSNL may pay additional
liability as done before.
The file relating to revision of pension for
the employees who have retired before 1.1.2007 and drawing IDA pension has
been sent back from DoT to BSNL with a list of objections. We will once
again take this issue with DoT very
soon.

Our
association which has exclusively taken up the issue relating to simple
accounts examination in the cadre of Civil and Electrical has met
success as the same has been approved by the competent
authority. The approval says that instead a two week training will be
conducted at RTTCs and ALTTC followed by an examination i.e
examination will be an integral part of training. We had received an
overwhelming response on this issue specifically from all the southern
Circles, WB, GJ,PB, UP(E),UP(W) ,MP etc. CHQ is extremely
thankful for their support and exemplary patience. We are hopeful for more
pragmatic decisions in Civil/Electrical Wing. Necessary orders will be issued
very soon.
On ACP
issue we have received various representations across the country. This
issue is causing serious heartburning to our comrades. Our GS is fully
apprised on the issue and very shortly GS will address the issue with a new

Issue
of 25 % competitive Examination.:The petitioners in Hon'ble Jaipur
high court were called by DGM(Pers.) & GM(Pers.) at Corporate office. In the
meeting they said that their concern was seniority in the cadre not
the staying of promotion (Competitive quota). Management has requested them to
submit a declaration on the account. We are hopeful that things will be
settled very soon.

Oct.,08: Meeting with Director (HRD) /BSNL:
GS along with Com Ballab Bose, CS/UP(E), met Director(HRD)
and discussed following issues elaborately. DDG(P) and Jt DDG(P) were also
present in the meeting.
A)Finalization of Gr A RRs based on the agreement with the united forum of
executives of BSNL: We impressed upon
Director(HRD) to take immediate action to promulgate Gr A RRs in line with
the understanding reached with the united forum of executives. Besides, we
informed Director(HRD) that some of the aspects of RRs like qualification,
age etc. for internal competitive examination for MTs which were left
uncovered in the understanding and on which we were specifically assured of
discussion at the time of framing and promulgation of Gr A RRs need to be
discussed. Director(HRD) assured of further discussion on these issues very
shortly.
B)Holding of DPC from TES Gr B to adhoc STS: Director(HRD) directed
DDG(P) to initiate immediate action to fill up about 1500 STS posts on adhoc
basis. DDG(P) assured that action to initiate DPC would be taken very
shortly.
C)Expediting holding of seniority cum fitness DPC from JTO to TES Gr B:
DDG(P) informed Director(HRD) that practically no Circle has sent so far the
information that BSNL hqs has sought for in regard to correction of EL
circulated by Hqs. However, DDG(P) informed Director(HRD) that within ten
days heads of Circles would be asked to send the CRs for processing and
going ahead with the seniority cum fitness DPC. Director(HRD) directed DDG(P)
to treat this issue on utmost priority.
D)Restoration of seniority of 1966 SDEs: We very strongly protested
over the delay in restoring the seniority of 1966 SDEs despite clear cut
Court directions from Ernakulam and Delhi High Courts, quashing reversion of
these 1966 SDEs. DDG(P) categorically assured that within fifteen days
action to restore the seniority of 1966 SDEs would be taken.
E)Issuing of promotion orders from JTO to TES Gr B against competitive
quota: DDG(P)
informed that he is making best efforts to issue the orders as early as
possible and is in constant touch with the legal cell of BSNL Hqs to break
the impasse created by direction issued by Rajasthan High Court. We urged
upon Director(HRD) to expedite issuing of orders by taking appropriate
action. We also informed Director (HRD) that if things are delayed too much,
then Association will get impleaded in Rajasthan High Court.

Oct.,08: 21st Circle Conference of TN
Circle at Thanjavur:
21st Circle Conference of TN Circle was held at
Thanjavur on 4th/5th Oct.,08 in a colorful manner,
with more than 600 members attending the open session on the evening of 4th
Oct.,08. The open session was addressed by the CSs of BSNL EU, NFTE, TEPU,
FNTO, DGM(A)/TN Circle
and GM/Thanjavur. Veteran Comrade, W. Seshagiri Rao, president/NCOA, CHQ
President, Com S.L.Reddy, and GS also addressed the open session. All the
speakers emphasized upon the need of continuous and sustained struggle from
the platform of Jt forum on issues of viability of BSNL. Key note address
was read out by Com N. Balakrishnan, CS/TN Circle.
GS addressed the delegate session on the morning of 5th
Oct.,08 and apprised the representative council about latest developments on
various cadre and other issues. GS’s address was followed by an interactive
session. Role of CHQ on the issue of 147 SDEs getting retrospective
seniority came in for criticism. However, GS, after explaining all the facts
relating to the issue, assured the representative council of seeking to
explore various options, including the legal one, to protect the interest of
seniors. Com Sunder krishnan, Com Ashokan and Com Jayraman were unanimously
elected President, CS and treasurer respectively.

October, 08; GS
addressed GB meeting of Chennai/TD.
GB meeting of Chennai/TD was addressed by the GS on the
evening of 3rd Oct.,08 in which GS elaborately mentioned the
latest position on various issues and the stand of the Association. CHQ
President, Com S.L.Reddy, and treasurer, Com Muthu, also addressed the GB
meeting. The meeting was presided over by Com Munuswamy, President of the
Chennai/TD Organization.
The stand of the CHQ on the issue of giving retrospective
seniority to 147 SDEs and promoting about 50 of them to STS came in for
severe criticism. Despite explaining of facts by GS, particularly in the
context of judgments from various High Courts and Supreme Court, the members
wanted Association to explore possibility of legal action, since it was felt
that a flood gate would be opened by such retrospective promotions which
would adversely affect the seniority of seniors in future. GS also explained
in detail the helplessness of the Association on the issue of fixation of
TES Gr B seniority in view of innumerable court cases being filed on the
issue. However, GS assured the members that Association would further try to
explore taking legal action on the issue to protect the interest of the
seniors who are adversely affected by such retrospective seniority fixation.
The
file relating to AAOs Pay scale was with SEA branch till 3rd of October
2008. It was referred by EF branch for their comments on the issue with the
reason that SEA branch is the nodal branch dealing with the issue. We are
surprised as why the file was sent to SEA branch as the nodal branch was SR
branch which has dealt the issue. Unnecessary delay has already taken by
tossing the file from one branch to the other, as the approval for the same
has come long back from DoT. We strongly feel and protest the delay in
approval of AAOs payscales.
The
orders relating to AO DPC are expected next week. All the request transfers
will be carried out and there will be minimum disturbance in the orders. We
are hopeful that all the request transfers will in accordance with some
decided policy.
Status of promotion of 25 % competitive examination: The necessary
details of the all the qualified candidates & VC have been compiled by the
personnel-II branch. The Promotions to the qualified candidates is a bit
delayed due to the so called stay in the Hon'ble Jaipur bench of
Rajasthan high court by a writ petition no.
4796/2007 filed by
one of the executive association. There is an element of ambiguity in terms
of applicability of stay. Concerned GM(Pers.) & DGM(Pers.) are totally
seized of the issue as a total of 1867 candidates have passed the exam. and
out of which more than 800 BSNL recruitee JTOs have been declared successful in
the same examination. We have also demanded that the promotion orders may be
issued at the earliest as the stay was granted by the Hon'ble Court till the
next hearing i.e 17.9.07. The matter has been referred to GM(legal) by the
GM(Pers.) for finding a solution in this regard.
