General Secretary was informed by the concerned officers of
DoT that the proposal of BSNL regarding merger of 50 % IDA with basic from
1.1.07 has been returned to BSNL for further necessary action, after
clearance of the proposal by Telecom Commission.
In a landmark
judgment, Hon'ble Supreme court dismisses the appeal filed by Reliance and
Tata Tele-services against the judgment of TDSAT in 2005 upholding the plea
of BSNL that
that held these services are not fixed line telephones, but limited mobile.
BSNL's stand vindicated.
SC
dismisses TTSL, RCom's pleas; 'have to pay Rs 700 cr to BSNL'.

Circle and Com. V. Suburaman GS TEPU met Hon'ble MOC&IT at Hotel ADIYAMAN
PALACE, Dharmapuri on 27th April, 08 to felicitate him and submit a
memorandum. GS requested Hon'ble MOC&IT to continue the ADC regime to
compensate BSNL for the loss that it incurs on rural operations. Hon'ble MOC&IT
informed the delegation that a mechanism to compensate BSNL for meeting
rural obligations is being worked out. On the issue of absorption of ITS, we
were informed by Hon'ble MOC&IT that the proposal of absorption of ITS Gr A

GB meeting at Bangalore:
GS addressed general body meeting of Comrades from BG and adjoining
SSAs on 26th April at Bangalore, apprising the Comrades about developments

On 24th April 2008, Shri A.K.Chaudhary, Jt. DDG(P) has written DO to
Chief General Managers of all the Circles to sent the soft copy of the the
eligibility list for promotion from JTO to SDE by 15.5.2008 as the same is
badly delayed. Circle Secretaries are requested to check the same and ensure
that the soft copies are sent on Jt.DDG(P)'s e-mail address. The compliance

2. The Promotions
from JTO(C) to SDE(C) are delayed as Sr. DDG(BW) is on leave due to the
sudden demise of his wife and is likely to join duties next week.

exam of Civil/Electrical wing.

in DoT faces flak from Planning Commission:
For
its failure to fully utilize funds allocated under USOF for the year
2007-08, planning Commission reduces allocation for the year 2008-09 by 900
crores, scaling it down from Rs 2900 crores for 2007-08 to Rs 2000 crores
for 2008-09. Whereas DOT is trying to justify under utilization of funds due
to delay in land acquisitions, but the hard fact remains that bureaucracy in
DOT was completely engrossed in chalking out policies to safeguard interests
of the private service providers and in the process it had very little time
to devout to utilization of USOF for growth of rural services.
So far out of total Rs 20,000 crores collected by MOF from this levy from
service providers, just a meagre Rs 5000 crores has been disbursed by MOF
from USOF. Service providers contribute 5% annual revenues to the USOF,
which is used for telecom infrastructure in rural
India
. All telecom COs can avail subsidies from the USOF on a bidding basis for
rolling out both fixed line and wireless networks in rural
India
.
** Parliamentary standing committee slams DOT, BSNL and MTNL for their poor
performance in under utilizing funds allocated to them in the 10th plan
period vis-a-vis other service providers -- policy makers in DOT ruthlessly
hauled and mauled.
Parliamentary standing
committee in its report has slammed DOT, BSNL and MTNL for its failure and
negligence in utilizing only Rs 40,959.06, out of Rs 71, 346.98 crores
allotted in the 10th plan period. The committee has also blamed DOT for its
total failure to act against state owned companies, BSNL and MTNL for their
underutilization of funds. Coming
down heavily on DOT and making a scathing attack on it, the report, tabled
in Parliament, says " The extent of shortfalls that have been observed
in the utilization of funds during the 10th plan can't be condoned under any
circumstances." The observations of the
committee are not only revealing but adversely reflect on both the policy
makers in DOT as well as the managements of both PSUs. The committee
virtually accuses DOT, the administrative ministry, for its utter failure to
oversee the functioning of the telecom PSUs, and mentions that it cannot
skip its responsibility and allow both BSNL and MTNL to under perform. The
apex committee has been unsparing in its attack on the managements of both
BSNL and MTNL by pointing out "In
such a dynamic sector where competition is so intense, the inability on the
part of telecom PSUs to foresee these compulsions is unacceptable to the
committee, more so when there has been an underutilization of funds year
after year". This
striking observation of the committee more than clearly establishes our
considered view point that ITS dominated BSNL management is not only
lethargic, unprofessional and incompetent, but needs to be immediately
replaced by a thoroughly professional and result oriented management. The committee has
pointed out a slew of issues that was impacting the competitive performance
of BSNL and MTNL. In the case of BSNL, the committee has pointed out that it
has utilized less than 60% of its budgetary outlay. The committee goes on
further to say that BSNL has failed to meet almost all targets with regard
to broadband, internet services, trunk automatic exchange, fixed line and
also wireless services. "in the intense competitive environment of the
telecom sector, the committee feels that it is high time that BSNL achieve
the annual targets in the earmarked schemes and projects."
In the light of the mauling and hauling of the policy makers in DoT and the
management of BSNL by the apex committee, isn't it ridiculous and absurd on
the part of the protagonists of disinvestments of BSNL to talk about floating an 10% IPO to generate funds for further
expansion of BSNL when 40% of the funds that Government had earmarked for
its growth in the 10th five year plan have remained unutilized. Is not the
slogan of policy makers in DOT regarding disinvestment of BSNL based on
extraneous considerations, having no relevance to the growth of BSNL. This
gives us tremendous scope to fully expose the sinister designs of all those
who are raising slogans of disinvestments of BSNL.

Meeting
with DDG(IR)/BSNL: GS,
along with AGSs, Com Sukhvir Singh and Com A.khan, were called by DDG(IR) to
discuss the issue of expediting the declaration of results of TES Gr B
competitive examination in the context of our concern conveyed to
Director(HRD) on account of continuing delay. DDG(IR) in detail explained
the reasons of delay, which appeared to be beyond his control. However, he
assured us that the entire process was going on quite fast and he expected
the results to be announced very shortly. From our side, we mentioned the
reasons of our anxiety because of delay which were appreciated.
Discussion
with CGM/punjab:
The
occasion was utilized to discuss the issue of denying local officiating
promotion to JAG to promotee STS officers with CGM/punjab, who was
incidentally present. We bitterly criticised his highly biased decision of
giving local officiating promotion to ITS who had put in less than two years
regular service in STS and denying it to adhoc STS already in the regular
scale of STS/JAG and having put in more than seven to eight years of service
in STS. We virtually condemned his biased action and informed him that such
discriminatory and prejudiced actions lead to bad blood in the field units
and adversely affect the functioning of BSNL. Even though CGM tried to
convince us but he failed to do so in view of the clear rule position cited
by us. Finally, CGM assured us that he would re-examine the whole issue very
shortly and be in touch with us. Our Comrades of punjab must go in for all
out struggle to comprehensively defeat such retrograde decisions of CGM/punjab
and in this fight for legitimacy and justice, CHQ will be solidly with
Comrades of Punjab.

Latest
status on merger of 50% IDA: GS met DDG(PG)/DOT who is looking after the functions of concerned DDG(SU)
to enquire about the latest position on the issue of merger of 50% IDA with
basic. BSNL board has already approved merger of 50% IDA with basic wef
1.1.07 and sent the file to DoT for its approval.
The
file has been sent to TPF section (telecom planning finance) by the SU
section of DOT to examine whether budgetary provisions on account of
payment of pension have been incorporated. Unfortunately, the delay is on
account of concerned DDG(TPF)/DOT also being on leave. It is gathered that
there is absolutely no hurdle that BSNL's proposal is likely to face and the
approval of DOT is expected within a couple of days.

has been constituted to recast the syallabii of Departmental Account

Further, it has also been decided that the examination will be an
integral part of the training schedule. The committee consists of Jt.
DDG(Elect.) as Chairman, Jt.DDG(BW) as convener and Jt. DDG(CA) as member.
The committee has to submit report within two months.

presentation was made by DDG(Restg.), BSNL in front of Management
committee, BSNL on 4th April 2008 regarding amended Transfer and Posting
Policy of BSNL for executives and non-executives. The minutes of the same

working committee meeting of our Association shall be held at
Chandigarh

. Hotel Parkview is owned by tourism department of Government of punjab and
isabout 14 kms from Airport, 10
kms from Rly. Station and 2 kms from ISBT. The hotel is fully air
conditioned, it's restaurant, conference hall, and rooms with attached bath
rooms, are all air conditioned having all the modern facilities.
Since
June is going to be the peak tourist season, and
Chandigarh
is virtually base camp for tourists to Shimla, we request Circle Secretaries
to strictly restrict participation to eligible CWC members only. We regret
to inform that due to limitations of availability of accommodation, we shall
not be in a position to entertain any request for participation of anyone,
other than eligible participants, as observers etc. Circle Secy's may kindly
observe this strictly.
Since
June is holiday time and peak of summer, reservations, to and fro, should be
made right now. That is why we are giving sufficient time, to avoid
inconvenience. There is excellent connectivity between
Delhi
and
Chandigarh
. It takes three to four hours by both Road Transport from ISBT and Rlys
from New Delhi Rly Station, With Shatabdi taking about three hours time,
starting New Delhi Rly station daily in the morning at 0700 hrs and evening
at 1715 hrs.

We have been advocating the same for the similarly placed AAO cadre. The
file from finance has reached DDG(SR) for placing the matter into BSNL board
for approval. Thereafter it will be sent to DoT.
2. The DPC from SDE to STS may take some time as vigilance clearance is
yet to be received fully from CVO's office.
3. The soft copy of Eligibility list for promotion from JTO to SDE has been
received from Orissa, NE-II and Gujarat only. Other Circles are yet
to send the same. Hard Copies have been received from 25 Circles. Circle
Secretaries , kindly ensure that soft copies are sent through e-mail/CD etc.
All

writes on Abolition of ADC by the regulator:
In an arbitrary move, TRAI, has, ignoring all the critical facts related to
and fully justifying continued payment of ADC to BSNL by other service
providers, decided to completely do away with ADC regime by sept.,08, thus
dealing a severe blow to the health of BSNL which has been consistently and
continues to discharge the exclusive responsibility of providing basic
services in remote and rural areas of the Country. Unmindful of the crucial
role that BSNL has been playing in terms of ensuring uninterrupted growth of
services in non remunerative and unprofitable inaccessible areas in the
Country, TRAI virtually succumbed to the pressures of the private Sector and
decided to abolish ADC. Regulator's public stand that BSNL would be
compensated from USO fund to the tune of Rs 2000 crores annually for three
years consecutively is completely misleading since there is no provision in
USO fund by which either DOT or TRAI can allocate Rs 2000 crores annually
to BSNL to support services in the rural sector. This decision is to be
taken by the Finance Minister since neither TRAI not DOT has any
jurisdiction over the manner in which USO fund is to be utilized.
Utilization of USO fund falls under the exclusive domain of Finance
Ministry.
Moreover,
in case TRAI is genuinely convinced about compensating BSNL for providing
services in far flung and highly unprofitable areas, then the very basis of
their recommending to abolish ADC and alternatively suggest compensating
BSNL through USO fund, on which it has virtually on control, is under
question, rather the recommendation itself is based on extraneous
considerations.
Thus
in order to register our strong protest against this arbitrary move of TRAI,
JF has decided to hold Country wide lunch hour demonstration at SSA/CGM
levels. All the comrades of SNEA (I) must fully participate in the lunch
hour protest action on 3rd April,08 and make the programme quite
successful.
