DPC from SDE to STS for left out cases of 39 SDEs is over. We have come to
know that orders have been signed and everybody is posted in the same

GS

The DPC for left out cases

AGS Com. Khan and GS, AIBSNLEA, Com. Prahlad Rai met DDG(Restg.) and had
a prolonged discussion to resolve some of the contentious issues
relating to transfer policy. The Discussions are likely to continue.
In
the DPC from SDE to STS all the Circle heads are requested to direct
vigilance heads of their circles to send the necessary vigilance
clearances of the officers falling in the zone of consideration by 3rd of

Valuation of perquisite of Accommodation
in case of BSNL employees in occupation of staff quarters for the purpose of
Income Tax >>>>>>>>>>>.(Management
Committee has approved that BSNL will pay Income Tax on perquisite of accommodation on
behalf of all concerned employees for the FY 2001-02 to 2007-08(AY2002-03 to
AY2008-09) to the Income Tax authorities by 31.3.2008).
We had taken up the issue from the platform
of United forum of vide letter
no.UF/CHQ/PERQ/2007-08 dated 29.11.07. Thereafter our
Association pursued the matter consistently by holding series of discussions
with the concerned officers , including CMD & Dir(F). Both these officers
had assured us of a favourable decision, even recently this Association just
prior to holding of MC meeting reminded CMD and other officers about
resolution of the issue . We are thankful to BSNL Management for taking
favourable decision on the matter. Our General Secretary has again addressed to CMD
vide his letter no. CMD/SNEA(I)/5/2-08 dated 22nd February,2008 on this
issue.

view of the above the Joint Forum has decided to defer the strike on
26.2.08.Congratulations to one and all on the
solidarity shown by Joint Forum.
In the
Management Committee meeting of BSNL it is reliably known that MC has
approved the reimbursement of the cost of the service mobile sets at a reduced rate for JTO/SDE/DE/DGM
and equivalent. Orders will be issued very shortly.
This has resulted because of the tough stand taken by our
Association.Congratulations to all the executives.

DDG(BBO) replies to our GS on the issues related to Broadband Operation vide
their letter no.
11-2/2008-BBO/36 dated 13.02.08. Remember ! GS had communicated to CMD,
BSNL about the problems faced in the P3 project vide our letter no. SNEA(I)/CMD/1/1-08
dated 16.1.08.
IDA merger: GS has learnt from very reliable sources that orders to give effect to
merger of 50% IDA with basic for officers of CPSUs w.e.f 1.1. 07 will be
issued by DPE either on 22nd Feb.,08 or latest by 25th Feb.,08.
Meeting
with Secy/DOT:
Representatives of the Joint forum of BSNL executives/non executives were
called for a meeting by Secy/DOT to discuss the issues contained in the
notice submitted by the Joint forum. CMD/BSNL, Director(HRD)/BSNL, Member(S)/DOT,
SP Secy/DOT, Member(F)/DOT DDG(SR)/DOT & BSNL were also present. SNEA(I) was
represented by GS. After discussing all the issues contained in the notice,
Jt forum decided to make complete and all out preparation for making the
ensuing strike from 26th Feb.,08 completely successful.
Comrades of SNEA(I) throughout the Country at all the levels must make all
out preparataion to ensure hundred percent participation of members of
SNEA(I) in the strike. Let us clearly understand that disinvestment
inevitably & surely leads to privatization and present move to off load 10%
equity of govt. in BSNL is nothing but the beginning of the ultimate process
of privatization of BSNL. Let us get ready fully to defeat this sinister
move of the govt. with all our might and deep rooted conviction that we have
in the success of our legitimate and just struggle.
Proposed ADC
reduction by TRAI:
Response of
SNEA(I) to the consultation paper on Access Deficit Charges and its
subsumption into Universal Service Obligation Fund ( USOF ) at Hotel
Meriddien, New Delhi, on 19th Feb.,08.SNEA(I)
represented by GS, Com A.Kaul, CS/Delhi, Com G.Das, CS/Corporate office and
Com S.K.Aggarwal, CWC member/Delhi made a detailed submission in the open
house session conducted by TRAI on the issues contained in the consultation
paper on ADC on the following lines.
General:
Financial assistance to BSNL mentioned in annexure II under various heads is
completely misleading and distorted. Nothing can be more untrue than
carefully manoeuvred and motivated attempt being made by the regulator to
create and convey an impression that BSNL is just surviving on subsidies of
the government and the private operators so as to justify abolition of ADC.
What is highly objectionable and irrational on the part of the regulator is
its deliberate sinister move to undermine the critical significance of the
initiatives undertaken by BSNL for which it legitimately received funds and
which are being falsely shown as subsidies.
And even worse
is the misleading effort of the regulator to reflect its own policy
decisions like payment of ADC etc. taken after extensive debate and
comprehensive analysis and consultation for providing much below cost wired
services in remote and inaccessible areas of the Country where private
sector has neither so far ventured nor has any inclination to venture in
near future to provide services as subsidies granted to the state owned
company by the private operators. This goes only to clearly demonstrate and
strengthen the fact that regulator has extremely feeble conviction with
regard to its own policy decisions and is quite vulnerable to take a U turn
at any point of time on any decision it has taken to protect the interests
of private operators. The regulator in its relentless pursuit to appease
private sector at the expense of the incumbent operator is quite ready to
lose the very objectivity and basis on which it has formulated policies. By
acting in such a highly non objective and partisan manner, the regulator is
fast tending to lose its credibility and virtually becoming a mouth piece of
the private operators.
This is
clearly demonstrated by the following facts with respect to what are shown
as subsidies and contained in the annexure II of the consultation paper.
A)
Reimbursement of licence fee and spectrum charges:Under this head, BSNL is shown to have received a subsidy of Rs 9248.86
crores. To treat this amount as subsidy is just baseless when viewed in the
context of NTP 1999 which has come into existence through an act of
parliament . NTP 99 unambiguously states;
"However, as
DOT is the national service provider having immense rural and social
obligations, the govt. will reimburse full licence fee to the DOT".
Consequent upon corporatization of DOT and formation of BSNL, these
functions of providing services in the remotest parts of the country and
meeting social obligations of the government were discharged successfully by
BSNL. It is incomprehensible as to how reimbursement of licence fee by DOT
to BSNL can be considered as a subsidy. This commitment of reimbursement of
licence fee, even though partially met by DOT, is to meet the huge
operational and installation expenses incurred for providing services in
highly unprofitable, non remunerative and far flung areas. By any stretch of
imagination, the reimbursement of licence fee cannot be classified as a
subsidy. If these exemptions granted to BSNL as a consequence of the policy
decisions of the govt. are treated as subsidy, then Rs 1,24,000 crores that
private operators were committed to pay as fixed licence to the govt. when
they entered telecom sector and which was finally waived off when they were
permitted to change over to revenue sharing arrangement should be treated as
subsidy to the private sector. The issue of subsidies has to be considered
in its entirety, not in isolation, and that too keeping in focus BSNL,
completely ignoring private sector.
B) Moratorium
on payment of interest: Consequent
upon conversion of DOT into BSNL, some capital was needed by BSNL to meet
its operating expenditure and this was raised in the form of loan from DOT.
Borrowing of money from DOT by BSNL is purely an internal working
arrangement arrived at between the two i.e DOT and BSNL. What has to be
essentially recognized and understood here is that fundamentally the entire
capital of DOT belonged to BSNL and it was just on the eve of
corporatization merely to overcome technical problems arising out of
conversion of DOT into BSNL that some working capital was needed by BSNL,
and, as an interim measure, to overcome the situation arising out of such
sudden conversion, money was borrowed from DOT by BSNL to immediately meet
its operating expenditure. To treat interest payable on the borrowed capital
as a subsidy is simply ridiculous.
C) Reduction
in tariffs consequent upon reduction of ADC:To attribute
fall in tariffs in mobile sector to reduction in ADC is completely false.
The fall in tariffs has come about due to unprecedented growth of mobile
services. In fact, mobile tariffs have witnessed a steep increase consequent
to reduction of ADC last time.
D) Unbundling
of copper cable:Broad band services have not grown because of continued
reluctance of private sector to invest to deploy fibre or satellite for last
mile. Instead, private service providers have a parochial perspective of
being allowed to utilize the last mile copper of the incumbent operator
which it has laid prior to corporatization of DOT and without any kind of
assistance from private telecom sector. World over broad band penetration
has enormously increased because of huge investments of the private sector
in deploying last mile fibre / satellite which is yet to be witnessed in
India. Moreover, BSNL badly needs the copper infrastructure to meet its huge
roll out obligation in broad band segment.
E) Rebalancing
of tariffs:Rebalancing of tariffs cannot be accomplished so long as
private sector does not voluntarily participate in and contribute towards
growth of basic services in rural areas. It is impossible to achieve this
objective so long only single operator provides services in highly
un-remunerative inaccessible areas and the anomaly of disparity in tariffs
will continue. Any service provider shall have to be necessarily compensated
for providing services in remote areas, and since this burden is entirely
falling on the shoulders of BSNL, ADC has to continue till private sector
fully participates in the growth of rural segment. Besides, TRAI has never
monitored roll out obligations to be met by the private service providers,
and , thus, has virtually encouraged them not to contribute to the growth of
rural services.
The views
expressed by SNEA(I) on the above issues contained in the consultation paper
were strongly and solidly supported by Com Dr Prabir Purkyastha of Delhi
Science Forum and Com K. Ashok Rao, SG/NCOA.
Meeting
with Director(HRD): GS met Director(HRD) and discussed following
issues. A) Results of
TES Gr B Competitive examination:GS informed Director(HRD) that abnormal
delay in declaring the results of TES Gr B competitive
examination has taken place and requested him to direct the concerned
officers to expedite the same. Immediately, Director(HRD) directed Sr DDG(IR)
to take necessary action to ensure that tabulation of results starts by the
end of Feb.,08. Director(HRD) also directed Sr DDG(IR) to give him the list
of GMs who are yet to submit their answer books after evaluation. B) Finalization of transfer policy:GS explained in detail various important
issues connected to the transfer policy whichneeded his
intervention, particular the one relating to age limit, duration of tenure,
making the transfer policy need based etc. Director(HRD) raised some
important points regarding the issues which were explained at length by GS.
Finally, GS requested Director(HRD) to issue necessary amendments based on
the suggestions given by the United forum and the discussions held thereof.
Director(HRD) assured GS that very shortly he shall convene conclusive
meeting on the issue and thereafter necessary amendments shall be issued. C) Issues related to the promotion policy:Director(HRD) wanted the
discussions on various issues connected to the promotion policy on which a
committee has been constituted. to be concluded shortly so that the
Management decides on
the recommendations of the committee as shortly as possible. GS assured
Director(HRD) that United forum is also quite keen to resolve the issues
pertaining to promotion policy as early as possible, of course, to the
reasonable expectations of the members of the constituents of the United
forum.
Meeting with DDG(CA): GS met DDG(CA) to
discuss the issue of replacing the existing accounts examination held for
Civil/Electrical etc. to get their increments on promotion by training
programme of which examination is part and parcel. GS mentioned in detail
the reasons which prompt replacement of the existing examination. DDG(CA)
assured that he would consider replacing the existing examination by a
training programme of which examination would be a part but the examination
would be on a different pattern from the one that is generally associated
with the trainings to actually test the capability of the officials.

Meeting with Dir(O)/ BSNL (Reimbursement of cost of mobile hand sets): AGS, Com Khan,
met Shri J.R.Gupta ,Dir (O), BSNL on 15th February 2008 and requested him to
take appropriate action on the matter pertaining to reimbursement of cost
for purchase of mobile Handsets to all the executives and get the same
approved by the Management Committee. Dir (O) was positive in this
connection and was able to clearly recollect our correspondence in the
matter & logic behind reimbursement of cost for purchase of mobile hand sets
by absorbed executives of BSNL and advised us not to be very tough on the
matter. He also informed us that MC meeting was not held in the week from
11th to 15th February 2008 due to absence of CMD and other board of
directors at Delhi. However, Director(O) assured of early psositive action
in the matter.
Meeting
with DDG(Rest):GS
and AGS, Com Khan, met MS Madhu Arora, DDG(Rest) and discussed some finer
and important issues of transfer policy. DDG(Rest) responded positively to
some observations made on some issues.

conference of Chandigarh Telecom District: District
conference of Chandigarh Telecom District was held on 13th February 2008.
Com. Inderjit Singh, Vice President CHQ, Com. A.A.Khan, AGS, Com. Sanjeev ,

Circle was attended and addressed the conference. Com. Barinder Singh, Com.
Prithipal Singh & Com. Vinod Kumar were elected as District President,
Secretary and Treasurer respectively. More than 150 members attended the
District conference and day to day developments in BSNL at Corporate level
were apprised by the CHQ leaders

All the Circle
Secretaries are requested to take a note of the above developments i.e there
are two jobs on topmost priority, Firstly the DPC from SDE to DE(in the
present instructions by BSNLCO it is emphasized that there won't be any
screening in the Circles, only the CR assessment of an individual are to be
compiled and sent to BSNL, CO in the prescribed dates, and the necessary
Vigilance Clearances of the covered individuals to be sent to Circle
Vigilance and in turn will be sent to CVO's office).
Secondly, The All India
eligibility list of JTO has to be prepared by BSNLCO, it is to be
ensured that all the JTOs serving in their Circle has to be included. In the
earlier E/L there were instances where the names were not included in the
first stage and subsequently the names were sent, which created problems in
promoting people.
The developments on the
above two issues should be apprised to CHQ regularly.

Issues of Civil & Electrical.
Competitive quota vacancies in the cadre
of SDE(C) are 63 and for SDE(E) are 46 in number. There are 147 number
SDE(C)'s vacancies in seniority cum fitness quota.
The DPC for promotion from SDE(C) to
EE(C) was held on 1st February 2008 for 34 no. of Vacancies. The DPC is
not over as some formalities are yet to be completed.
The list from JTO(C) to
SDE(C) is held up for want of Vigilance clearance of the following
SDE(adhoc). 1. R.P.Mukherjee-AS, 2. Soram Gopal Singh, NE 3. S.Ravi-MH,

DDG(Est.)
DOT has informed our GS that necessary permission to operate list no 4 & 5
has been accorded to BSNL for conducting DPC to STS.
Order
for the reversion of 1966 SDEs quashed by Kerala High Court - In the case
filed by SNEA comrades, Ernakulam High Court quashed the order for the
reversion of 1966 SDEs and the consequent revised seniority list published
in 2004.
