Important high lights.
A)
DOT clarifies that payment
of pension to absorbed staff in BSNL is the sole responsibility of the govt.
under the provisions of sub rule 21 of rule 37A of CCS pension rules 1972,
regardless of the fact whether BSNL is in a position to make pensionary
contribution to DOT or not. This sets at rest all the doubts about the role
and responsibility of the govt. to pay pension to all those absorbed in BSNL
from DOT.
B)
BSNL has approved the pay
scales for executives in accordance with the orders of DPE except that for
JTOs and SDEs it has approved mid scales of E1A and E2B. These scales along
with the 30% fixation of IDA pay w.e f 1.1 2007 as approved by DPE have been
sent to DOT for issuing of presidential orders. We expect the proposals to
be cleared very soon by DOT.
C)
A committee to decide future
perks for executives has been constituted under the Chairmanship of
Executive Director/finance, Corporate office, Sh S.R.Kapoor. Association
shall be interacting with the committee very closely.
D)
Decision regarding revision
of IDA pension on CDA pattern in accordance with 1972 statutory pensionary
rules is being awaited from Ministry of law.
E)
DOP & P(W) clarifies that it
has nothing to do as far as issue of merger of 50% IDA with basic for all
those having retired prior to 1.1.2007 is concerned. DOT now has sent the
file to DPE for getting its approval on this issue.
F)
We make an fervent appeal to
the CSs of all those Circles from where CRs from JTO to TES Gr B promotion
have not come to ensure that CRs are sent as expeditiously as possible so as
to get the promotion orders from JTO to TES Gr B against seniority cum
fitness quota issued as early as possible. This must be treated on utmost
priority.
G)
DPC from TES Gr B to adhoc
STS expected to commence shortly.
H)
Gr A RRs are expected to be
notified very shortly. Various discrepancies contained in the draft Gr A RRs
have been set right.
I)
Sweeping reforms in the
existing structure of BSNL are expected to be introduced very soon. Boston
consultants are presently examining the whole issue of bringing about
sweeping changes in the organizational structure so as to create exclusively
vertical and independent wings in business development and growth,
marketing, sales, GSM, HR and all other related aspects that help BSNL in
meeting the stiff emerging competition in the telecom sector effectively and
successfully. We are in touch with the consultants to give them our inputs.
Inputs from the field units on all these critical issues would be quite
useful, relevant and must be immediately mailed to CHQ.

VERY URGENT: JTO to TES Gr B DPC is getting inordinately delayed primarily
due to complete indifference of our CSs to get involved in the process of
expediting sending of CRs from their circles for the last more than six
months. Despite our continuous and persistent requests to CSs to send the
CRs since Sept.,08, it is very sad that only a few following circles have
send the CRs and the majority of following Circles are yet to even get
involved in the process of CR collection. This is a very serious and sad
matter. GS emphatically wants to make it clear that in case, within a
reasonable time of ten days from now, the Circles mentioned above are not
sending their CRs, CHQ office bearers will be deputed personally to these
Circles for getting this job done. This would be an unpleasant action on the
part of CHQ, but, unfortunately, an unavoidable one for obvious reasons. We
cannot see JTOs languishing to get promotions for months together merely
because of our inaction.

27.1.09 positively. |

We have come to know that only from 3 circles have sent the Vigilance
clearance reports in connection with JTO(Civil) to SDE(Civil) promotion. The
circles are MAHARASTRA(Nagapur),West Bengal (Kolkata) & Gujarat. All the CSs
Kindly coordinate with our AGS Shri Chandrasekhar. |

TRAI recommendation on unbundling of last mile
copper cable: BSNL
not able to meet the Govt. Broad target. Hence TRAI recommends to unbundle
BSNL/MTNL cable for franchises to provide broadband. Comrades you must act
and provide as much broadband connections possible as this is the only one
area which we can concentrate and generate revenue in landline sector. By
this we can save BSNL and scuttle the plans of TRAI and others.

Attention of CSs/SSA Sec:
BSNL CO issued clarification regarding Refund of stipend arrears on IDA
scale for JTOs recruited by BSNL. All CSs are requested to take up the issue
with the concerned CGMs to refund the arrears at the earliest as stipend was
paid by different RTTCs.

AGS Com. Khan and CWC member Com. Cheema met GM(SR), Shri Shakeel Ahmed
(member in the Committee formed on ACP) on the issue of ACP. We submitted
various supportive documents and arguments with sound rationale on the
issue. The discussions were positive. |

Way out to curtail expenditure on tours

Meeting with M(S)/TC: As a follow up action of the advise given by Secy/DOT
on the issue of deferred option case, GS and AGS, com Khan, had very
extensive and useful discussions with M(S)/T( C ) who was completely
convinced about the correctness of the orders issued by BSNL regarding mode
of fixation. In fact, MS) in our presence had extensive discussions with
senior officers of finance and establishment who emphatically endorsed the
view point of M(S). In fact, M(S) clearly felt that the very purpose of the
order is defeated in case fixation is done from CDA to IDA on promotion. The
entire order is rendered in fructuous in that situation, M(S) felt. After a
thorough discussion, M(S) assured that he would discuss the issue with M(F)/T(C)
and other senior officers of Telecom officers. In fact, M(S) clearly felt
that there is absolutely no need to get this issue placed on the agenda of
Telecom Commission since this is an issue needing correct interpretation of
the rules already mentioned. He asked us to get in touch with him in a
couple of days. We shall be following this issue quite closely.
Gr
A RRs; we reliably learn that Gr A RRs based
on the understanding that we had with the Management are being very shortly
being placed before MC of BSNL for its consideration and approval. This is a
positive development.
Meeting
with Secy/DOT; GS along with AGSs, Com Khan and Com Sebstin met Secy/DOT and
requested his kind intervention to decide the issue of deferred option to
continue in CDA scale till promotion/retirement in accordance to the true
spirit of the order contained in absorption. We informed Secy/DOT that
despite best efforts of Sh D.S.Mathur to get the issue positively settled,
DPE is maintaining its stand that this option is available only to those
PSUs which were not given point to point fixation, whereas, BSNL which has
been given point to point fixation, this option is not available. However,
Secy/DOT was kind enough to inform us that he would try his best to do
something and asked us to move the case once more. |

NIC cards, we have come to know that efforts are on to extend the same upto
31st March 2009 which had expired on 31st December 2008. Very few circles
have sent the feedback on the same.

Latest
status on IDA scales: IDA scales and fixation of pay approved by BSNL
board in its meeting on 7th Jan.,09 has been referred to DOT for
approval.
MEETING WITH DIRECTOR (HRD):
GS and AGSs, Com Khan and Com K.
Sebastin met Director(HRD) and pleaded with him to finalize and promulgate
Gr A RRs based on the understanding reached between the management and the
united forum. We strongly protested when Director(HRD) informed us that it
will take a few more months to finalize since the whole issue of
finalization of Gr A RRs has to be finalized in consultation with a
consultant B.C.G ( Boston Consultants Group) appointed by BSNL Management to
decide on various issues of growth, business development, HR, Sales,
strategies to face our competitors, marketing etc. However, we made it very
clear to Director(HRD) that referring Gr A RRs on which conclusive decisions
have been already taken to BCG consultants is nothing but a clear breach of
understanding and trust and we are not at all going to accept this kind of
tactics of dilly dallying by the Management.
We made it quite clear
to Director(HRD) that in the name of setting up of a consultant, thousands
and thousands of STS officers working on adhoc basis for more than ten years
cannot be deprived of their regularization in STS and promotion in JAG.
While non absorbed officers are getting their timely promotions and their
issues are not being stalled in the name of referring it to one consultant
or the other, it is completely unjustified to play with the sentiments of
the absorbed officers by denying their regularization on one flimsy and
concocted ground or the other. This is a very serious matter and will force
the Association to take on the streets immediately unless Gr A RRs based on
the understanding is promulgated immediately.
Against the background
of this serious development, we should not loose any time in gearing up
organizationally to defeat this belated conspiracy of the Management to
inflict injustice of worst kind by backtracking on the understanding
reached. This breach of commitment and trust has never been accepted by us
in the past nor in the future. So get ready for a decisive struggle.
Comrades, take this appeal very seriously and start making hectic and
intense organizational preparations to expose and defeat the double designs
of the Management. We shall be very shortly responding to this serious
situation in a befitting manner and in no manner shall we allow any kind of
dilution in the understanding reached between us and the management on Gr A
RRs to take place. This is a great organizational challenge for us and we
are confident to defeat the designs of the Management as regards their
brazen faced breach of agreement and understanding on promulgation Gr A RRs.
DEFFERRED OPTION (OPTION TO CONTINUE IN THE DA SCALE TILL NEXT
PROMOTION OR RETIREMENT): Again DPE
rejected the proposal sent by DOT with a very positive note regarding
deferred option and returned the file. It is learnt that DPE rejected the
proposal on the same ground as reported earlier that this option is
applicable for those only CPSUs where point to point fixation was not given
and in BSNL point to point fixation was given at the time of absorption. GS
along with AGSs Com. Khan and Com. Sebastin met Member (Production) Sri.
Sridhara who is holding the charge of Member (Services) and discussed the
issue of deferred option and requested him to settle the issue in DOT
itself. Association explained the background of the entire issue and
mentioned that it is part of the terms and conditions for absorption and
presidential order. The same option is included in the terms and conditions
for Group A absorption also. M(S) assured that he would try to examine the
whole issue in its entirety and take a final view. In the meantime,
Association will be meeting Secretary, DOT tomorrow, on the same issue.
CIRCULAR TO CIRCLE SECRETARIES

the Chandigarh CWC meeting in order to suggest ways to reduce land line
closure, reduce operational expenses, check revenue leakage and corruption,
methods to strengthen marketing and market our products and study different

Member Secretary, ACP committee:
AGSs Com. Chandrasekhar, Com. Khan & Com. Sebastin along with Com. Satpal
Cheema, CWC member met Sri. Sourabh Tyagi, DGM (Ele) and Member Secretary,
ACP committee and held detailed discussions lasting over two hours about the
implementation of first ACP in Civil/ Electrical etc wings. He assured to
arrange another meeting with the full committee shortly.
Meeting
with DGM (IR):
AGSs Com. Chandrasekhar & Com. Sebastin along with Com. Satpal Cheema,
CWC member again met DGM (IR) regarding announcement of SDE/AEE (C/E)
Accounts examination results and pleaded to delink it from the same
examination to be held at J&K. After discussion he assured that the results
will be announced after completing the valuation and other formalities
without waiting for the examination to be held at J&K. |

ALL CSs/SSAs/CHQ office
bearers and activists of the Organization at all the levels:
The Govt. has come down heavily on our fraternal friends in
the oils sector struggling to get the justified pay scales recommended by
the 2nd pay panel committee implemented. The recommendations of
the 2nd pay panel have been mercilessly and brutally slaughtered
by the all powerful, irrational and senseless bureaucracy of the Govt. of
India. Comprehensive job undertaken by the 2nd pay panel to
finalize its recommendations relating to pay scales and other related issues
of officers of CPSUs in the most scientific and meticulous manner by
involving all the experts and professionals from different wings of
management, man power deployment and utilization, finance etc. and taking
very vital inputs from various renowned consultants has been thrown to the
dustbins by the feudal lords, the bureaucrats in the Govt. This job of
finalizing the recommendations which was conducted by the 2nd Pay
panel in a truly professional manner, taking into considerations all the
aspects of critical role of CPSUs in building a formidable national economy
and immensely contributing towards building up of strategic developmental
and growth oriented infrastructure has been completely watered down by a
group of Secretaries completely devoid of scientific analysis and sense.
This painstaking and scientific work of the 2nd pay panel
spreading over 18 months has been totally diluted by the vested
interest bureaucracy in the Govt. in just two sittings.
Now when the officers of the oil sector have raised their
legitimate voice against mighty bureaucracy for their highly irrational and
senseless acts, the Govt., instead of going into the crux of the matter to
resolve the justified issues, has preferred to invoke repressive colonial
draconian laws like ESMA to crush a legitimate, peaceful and democratic
struggle. The repressive measures invoked by the Govt. deserve condemnation
of the highest order in the most unequivocal terms. It is an attack on
legitimate trade union activities on which pillars of democracy are erected.
It is ridiculous on the part of the Government to resort to such repressive
colonial measures to crush what can be safely termed as legitimate and
justified struggle to expose the misdeeds of the bureaucracy in the Govt.
Thus, Comrades, it is the bounden duty of each and every
Comrade of SNEA(I) to out rightly condemn these repressive measures of the
Govt. in the strongest possible manner, thereby conveying it to the Govt.
that under no circumstances can this Association allow the Govt. to let
loose any kind of repressive measures to slaughter legitimate and just trade
union activities by invoking repressive colonial measures in the name of
maintaining essential services.
We thus appeal to our CSs/SSAs/BSs and activists of the
Organization at all the levels to send following

The members of SNEA(India), -------Circle/-------SSA/----------Branch of BSNL strongly and
unequivocally condemn the dastardly and repressive measures let loose by the
Govt. in the form of unwarranted arrests, dismissals and suspension of
hundreds of officers of the Oil Sector struggling legitimately and
democratically to secure justice denied to them by irrational and vested
interest bureaucracy of Govt. of India. The officers of the Oil sector are
genuinely and seriously agitated over the arbitrary and high handed manner
in which the mighty bureaucracy of the Govt. completely diluted the
meticulous and scientific recommendations of the 2nd pay panel
constituted by the Govt. to decide pay scales and other related issues of
officers of CPSUs. Letting loose of draconian colonial repressive measures
to curb and crush democratic trade union movement reminds us of dark
Colonial days of the mighty British Empire. We urge upon your Hon’ble self
and make a fervent appeal to you to stop the repressive measures forthwith
and initiate process of reconciliation not only to restore normalcy but also
address the critical and significant issues raised by our agitating
fraternal friends from the oil sector failing which we shall be constrained
to immediately and actively join our fraternal comrades of the oil sector in
their just and legitimate struggle.

The BSNL board in its meeting today has approved the new IDA pay scales and
30 % pay fixation as approved by DPE. It is also learned that board has
approved E1A / E2A (Mid pay scales) for JTO/SDE as an interim measure and
E3, E4 etc. for Sr. SDE, DE etc. Very shortly this will be sent to DoT for
final approval and notification being the administrative ministry.
GS along with AGSs Com. Khan, Com. Sebastin & Com.
Chandrasekhar met PGM (IR) and discussed 1) JTO(C/E) to SDE (C/E)
competitive examination results, 2) JTO(T) to SDE(T) comp. examination and
the pattern of examination, 3) Accts examination results for JTO (C/E), SDE/AEE
(C/E) and 4) recruitment of JTO (C/E). JTO to SDE (C/E) competitive
examination results will be declared after conducting the examination for
J&K scheduled to be held on Feb: 15th, 2009. Simple Accts examination
results for JTO (C/E) will be announced within a week and SDE/AEE(C/E)
results will be declared after conducting the examination for J&K. Rectt of
JTO (C/E) is under process.
We also met GM (Legal) on the issue of seniority of 1966 SDEs and assured us
of favourable action.

DOT vide order no 40-12/2007-Pen(T) dated 5th Jan. 2009 reiterates that the
Govt shall take full responsibility of payment of pension (including family
pension) to all the employees of DOT absorbed in BSNL under the statutory
provisions of sub rule 21 of Rule 37A of CCS pensionary rules 1972,
regardless of whether BSNL is in a position to make pensionary contributions
to DOT or not. This is an extremely positive development and sets at rest
all the doubts about the responsibility and role of Govt to pay pension to all those
absorbed in BSNL from DOT. Association has had been tirelessly struggling to
get this clarification issued for the last more than two years.<<Click>>>
Issue of merger of 50% IDA with basic for those having
retired prior to 1.1.2007: Association was informed by M(F)/DOT that the
file for clearance of this issue is being sent to DPE since DOP & P(W) has
informed DOT that they have no role to play in this issue and has suggested
to send the file to DPE. A positive note is being sent to DPE by DOT on this
issue.
Association met Secy/DOT and expressed its profound
gratitude to him for getting the orders relating to payment of pension by
the Govt. to absorbed employees of DOT in BSNL issued, after getting due
clearance from Department of expenditure (MOF) and DOP & P(W). Secy/DOT
assured that he is trying to expedite the clearance of issue of revision of
pension on CDA pattern from Ministry of law and said it will take a little
more time to get settled. After getting clearance from Ministry of law, the
process of absorption of ITS Gr A in BSNL would be expedited and completed
as soon as possible, Secy/DOT mentioned. The same assurance was given by M(F)/DOT
on the specific issue of revision of pension on CDA pattern as far as
IDA scales are concerned. |

CRs and Special Reports from most of the Circles have not
been received so far inspite of the fact that the last date was 31.12.2008.
Circle Secretaries and concerned Joint Secretaries, CHQ are requested to
ensure that the pending CRs and SRs should reach BSNL CO urgently. The
status may be reported to CHQ by the Jt. Secy./CS by 9th Jan'09 over

standard Pay Scale E2 &E3 for JTO's and SDE,s in case management goes ahead
with extending mid scale to JTO &SDE,then,in that situation,we should all be
fully ready to resort to industrial action at very short notice .Start

Meeting

CMD and discussed following important issues.
A)
Regularization of existing adhoc STS officers and their promotion to regular
JAG and filling up of STS vacancies on regular basis:
CMD mentioned that consequent upon finalization of Gr A RRs
which are likely to be finalized shortly, the process of regularization of
adhoc STS officers and their promotion to JAG would commence. Also filling
up of STS vacancies on regular basis to the extent of 50% of ST posts would
also start immediately.
B)
Recruitment of JAG officers in specialized areas of business
development and growth, marketing, sales, HR etc:
On this important issue, we emphatically mentioned that the entire exercise
of recruiting professionals at JAG level in highly specialized areas of
business development and growth, sales, marketing etc would be
completely defeated in case professionals in these key areas are recruited
at SAG level also so that these JAG officers report to professionals in
these areas who shall be taking right policy decisions in these critical
areas of growth of BSNL. In case these JAG officers have to report to
existing SAG officers, having absolutely no background, knowledge and
expertise in these crucial areas, the whole process would be derailed.
Besides, these JAG and SAG officers to be recruited in these areas should be
permanent employees of BSNL, not merely on contractual basis. Recruiting
them on contractual basis would prove counterproductive because they would
lack sense of belongingness to the organization that is so vital for its
growth. Our suggestions were very well received by CMD who assured positive
consideration of our suggestions.
C)
Review of the existing dual promotion policy:
We were
very happy to know from CMD that he does not find any need of having two
channels of promotion for executives. Instead, he was of the opinion that
promotions up to STS should take place on time bound basis, with change of
designations as is prevailing in CPSUs. Promotions to JAG after reaching STS
should be linked to availability of posts. There should be no parallel post
based promotion up to STS, CMD was of the opinion. We informed CMD that
basically this is our demand for which we have struggled a lot, but,
unfortunately this basic demand of ours was never agreed to by the BSNL
Management. CMD mentioned that he would discuss the issue with the concerned
officers on the above lines.
D)Formation
of exclusive wings for sales and marketing at SSA levels:
CMD wanted full support of the Associations to introduce a fool proof
mechanism to
having
exclusive wings of sales and marketing at SSA levels. We assured CMD that
his initiatives on this important issue would be fully supported by both the
Associations in all respects. It has to be our endeavour, therefore, to
ensure that full fledged wings of sales and marketing come into existence at
SSA levels. Our CSs, SSA Secy’s and activists of the Organization must get
fully and whole heartedly involved in taking serious initiatives to build up
these wings in a formidable manner. This is an extremely important challenge
before us which has to be taken up with great determination and commitment.
E) Replacing existing mid scales for JTOs and SDEs
by standard E2 and E3 pay scales as decided by the Govt.
We
explained in detail the entire background of the issue in the context of the
classification of BSNL in A+ category bt the pay committee and the decisions
of the govt. to introduce standard pay scales for CPSUs in A category. We
strongly pleaded with CMD to end the existing anomalous situation of having
mid scales by replacing them by standard scales approved by the govt. As far
as financial impact of introducing standard pay scales from E2 to E7 is
concerned, it is just negligible because all the existing executives have
crossed the minimum of standard pay scales. The only limited implications
would result in the form of increase of pensionary contribution by BSNL. CMD
said that replacing mid scales by standard scales would have to be approved
by DPE since mid scales are having approval of DPE. We requested CMD to
initiate processing of the scales so that it can be vigorously pursued at
DOT and DPE level. CMD assured that he would consider our request. |
