!!! Adhoc STS promotion orders for 1679 SDEs
issued

OC -- 1308 (upto seniority no. 15300), SC -- 286
(upto
seniority no. 16221.1) and ST -- 85 (upto seniority no. 24491). 149 SDEs out
of 1679 are posted outside the Circle mostly due to shortage of vacancies.
We
are extremely thankful to DIR(HR), GM(Pers), CVO, DGM(Pers), AGM(DPC) and
the entire executives and staff in DPC, CVO office and Pers-I Section for
issuing the promotion order by maintaining the SC/ST quota, based on roaster
position. |

Meeting
with Director(HR) regarding issuing of promotion orders to adhoc STS:
GS along with both the AGSs had a
discussion with Director (HR) and GM (Personnel) regarding issuing of
promotion orders from TES Gr B to Adhoc STS as early as possible.
During the
course of discussion, it was revealed that promotion order for entire 2400
SDEs cannot be issued because of availability of inadequate number of SDEs
belonging to the SC category. The overall size of the promotion order had
thus to be scaled down to about 1700 odd so as to fully comply with the
provisions of SC/ST roster. While fully appreciating and acknowledging the
stand of the Management to fully adhere to the provisions of SC/ST roster to
protect the legitimate interests of SC/ST Comrades, we strongly pleaded to
initiate immediate action to call for the CRs of SDEs belonging to SC
category to issue the promotion orders of the remaining about 700 TES Gr B.
We were categorically assured by Director (HRD) that under all circumstances
the promotion of remaining 700 SDEs would be issued by the end of July,10.
From our side, we reiterated our stand that the roster provisions should be
fully complied with while issuing the promotion orders for the remaining 700 SDEs also.
The size of
the promotion order had to be thus reduced from 2400 to 1700 odd because of
non availability of CRs of SDEs belonging to the SC category to ensure that
proportion of OC, SC and ST in the promotion order is fully in accordance to
the prevailing rules of the government and SC/ST Comrades are not deprived
of their legitimate share while issuing the promotion orders.
We once again
made a fervent appeal to Director (HRD) to fully ensure that discrimination
of any kind is not met out to SC/ST Comrades and their legitimate interests
are fully protected. It is because of our continuous monitoring and
insistence to maintain the quota of SC/ST Comrades that the promotion orders
are issued fully in compliance of the roster provisions. However, all
efforts to issue the promotion orders of remaining 700 SDEs by including
appropriate number of eligible SC/ST Comrades to meet the roster
requirements are being made and we fully assure the remaining 700 SDEs,
including SC/ST comrades, that the promotion orders for them would be issued
by the end of July, 2010. CSs have to ensure that CRs being called for to
get adequate number of eligible SC/ST Comrades are sent to BSNL CO at the
earliest. A letter from BSNL CO in this regard is being sent to the field
units very shortly. |

CSs should ensure that the VC of Adhoc DEs for their regular promotions
to STS are send to BSNLCO by 03rd July. |
|
JAC decided for
nation wide campaign on the issues related to the Financial viability of
BSNL such as 3G and BWA spectrum charges, absorption of ITS officers,
Procurement of sufficient GSM lines etc. As part of this JAC decided for
post card campaign to Hon. PM by all the comrades by 05th July and
Conventions at Major cities. It is decided to conduct National
convention at New Delhi in the third week of July and regional
conventions at major cities before the National convention at Kolkatta,
Chennai, Bangalore, Hyderabad, Pune, Lucknow, Guwahati and Jaipur. MPs
and Central trade Union leaders will participate in the conventions.

BSNL rapidly heading
towards bankruptcy – reserves as on March, 11 – Minus 12559 crores –
this is the definition of bankruptcy of a commercial organization in
terms of simple financial language.
Are we aware of this
simple statistics and what it really means?
In simple terms it means the Company
will have no finances and means to pay for the monthly wages in the days
to come.
What is the monthly
annual wage bill inclusive of pensionary provisions, leave salary etc
for employees of BSNL – 12000
crores approximately.
Who are going to be
hit – all absorbed employees
of BSNL, except ITS, and their innocent families will shortly start
bleeding because of the financial crisis that has engulfed BSNL from all
sides.
Does BSNL have any
other resources except its fixed assets of land and buildings etc. to
meet the huge expenditure on annual wages, let alone future expansion
plans – No.
Who is responsible
for present deadly crisis -
government’s total lack of will and interest to groom BSNL as a viable
commercial Company as its 100% equity holder, frequent and uncalled for
political and bureaucratic interference in day to day business policies
of the Company, a thoroughly inefficient, unprofessional management,
devoid of vision and leadership qualities, prone to interference, and
fundamentally not owing allegiance to the Company, and trade
unions/associations cutting across all considerations and affiliations.
Can the situation be
retrieved and who can do that
– At this belated stage, when everything is virtually lost, only a
brave, spirited and determined fight and movement of the workers can
reverse the situation. Trade unions/associations need to understand that
it is meaningless to indulge in cat races to decide who is going to be
number one, two etc. It has no relevance in the present context where
workers and their families will start experiencing worst and
unbelievable financial situations very soon. Trade unions/associations
will be solely responsible for massacring their workers if they don’t
read the writing on the wall.

Objectives of and
critical issues before JACs at Central/Circle/SSA levels and the very
tough and unparalleled challenges that they face and have to overcome in
the days to come:
Objective of Joint
Action Committees at Central/Circle/SSA levels
–
Complete responsibility of building a
formidable and sustained Country wide movement to focus the crucial
and basic issues that require serious and immediate policy intervention
of the government to comprehensively address issues of viability on all
the fronts. Also to develop extraordinary sense of oneness and total
cohesion at base level among all the affiliates of JAC.
Immediately constitute
JACs at Circle/SSA levels and make them as highly proactive and vibrant
instruments of building massive media and public support for upcoming
struggles.
Huge challenges before
JACs at Circle/SSA levels:
to get proactively and fully
involved in arresting rampant and ever increasing corruption in the
field units, radically improve very poor quality of services, introduce
modern and business like customer interface, isolate work shirkers,
force management at Circle/SSA levels to enforce policy decisions that
help in improving quality of services, customer interface and growth.
What are the issues
– Pragmatic policy initiatives of the government relating to revival of
BSNL, a highly professional BSNL management belonging to the Company
having sweeping and absolute powers to take business and commercial
policy decisions without any interference from the bureaucracy in DOT
and investigating agencies like CVC, CBI etc., focus on right investment
policies and emerging areas of telecom business. |

JTO(T) to SDE(T) promotion:
The corrections in Eligibility list particulars are pending from the following Circles.
These circles are Bihar, Chattisgarh, HP, J & K, Kolkata TD, MH, NE-I
,OR, Punjab, TN, WB, ETR, ETP, NTR, STP, T & D, WTR. The DPC is held up
for want of corrected E/L particulars from the following circles.

Adhoc STS: As on 25.06.2010,VC from the following Circles not reached
BSNLCO -- AS, BH, ETP, GUJ(partial), HP, J&K, KOL TD, MH(Partial), NTR,
RAJ, TN and WB Circles. All CSs are once again requested to send
the VC positively by 28th morning. |

floated tender on 23.06.2010 for the procurement of 5.5 million GSM
lines for North and East Zones. BSNL planned to procure more Radio
equipments. |

Central JAC met Hon’ble MOC&IT Sh A. Raja at
Coimbatore on 25th June,10
Representatives of Central
JAC, including GS, met Hon’ble MOC&IT to seek his immediate kind
intervention regarding refund of 3G and BWA Spectrum Charges paid by
BSNL on the grounds that BSNL, being an incumbent operator fulfilling
the socio-economic obligations of the government with regard to ensuring
uninterrupted growth of telecom sector in remotest parts of the Country,
is fully qualified to pay spectrum charges for both 3G and BWA at
reserve prices, and in accordance to the provisions of NTP 1999
according to which BSNL paid a minimum charge of Rs 100 crores for 2G
spectrum. The reserves of BSNL are virtually exhausted by arbitrary
payment of about 18,500 crores as spectrum Charges for 3G and BWA and
with this payment
BSNL is all set to be bankrupt.
We pleaded with him to intervene as quickly as possible to save the
families of more than three lakh workers from being thrown on to the
streets.
Besides, we pleaded with
Hon’ble MOC &IT that BSNL has been subject to worst kind of
discrimination by not allowing it to bid for commercial Circles instead
of slapping pan India license fees for 3G and BWA spectrum.
Hon’ble MOC & IT fully
assured that he will very strongly plead these justified issues of
refund of spectrum charges by BSNL with Hon’ble PM and Finance Minister
who is also the Chairman of the eGOM for allocation of 3G and BWA
spectrum.
As regards continuing delay to address
the important issues of ITS absorption, revision of pension, procurement
of GSM equipment for immediate expansion and payment of 9.2 % IDA in
tune with orders of DPE, pointed out by JAC, Hon’ble MOC & IT also
assured that on his return to Delhi he will hold further discussions
with JAC regarding non settlement of these issues by DOT on which
Country wide strike was held on 20th April,10.
JAC clearly reiterated that bureaucracy
in DOT, particularly Secy-DOT, was taking absolutely no interest in
addressing and resolving the issues on which he gave very specific and
concrete commitments has been given on the basis of which strike of 20th
April, 10 was deferred by JAC.

CSs should take a serious note of the delay in
issuing Regular / Adhoc promotion orders to STS:
CHQ is very closely monitoring the progress of receipt of VC/ACR from Circles.
CHQ does not think it proper to publish the names of the Circles from
which VC/ACR not received till date. This is leading to unnecessary
delay in issuing of Regular / Adhoc STS promotion. Lack of serious
efforts on the part of CSs is a matter of utmost concern and delaying
the whole process.
CSs should camp at Circle offices from dawn to
desk to ensure that under any circumstances VCs/ACRs are received by
BSNLCO within a couple of days failing which CHQ will be
constrained to disclose the names of the Circles from which the required
information is not received at the shortest possible time.
CHQ should be
fully appraised of the latest updates on
a day to day basis by CSs/CHQ office bearers. |

DOT fleecing BSNL and playing havoc with its business - highly
prejudiced stand of owner of BSNL by levying discriminatory license fees
and spectrum charges -- GS writes to Hon MOC

Extension of benefits to TTAs (BSNL absorbed / recruited) selected as
Direct Rect JTOs as Dept Outsider -- orders issued for
1) counting of
past service for fixation of pay for JTO, 2) payment of salary during
training period instead of stipend, 3) carry forward balance leave, 4)
continue to be governed by Rule - 37A for BSNL absorbed TTAs, 5) payment
of TA for training, 6) exemption of police verification, 7)
exemption from further Bond etc.
Association was pursuing the matter
with DIR(HR), GM(Estt) and GM(EF) for months together. The case was
delayed since the case of TTAs recruited by DoT and absorbed in BSNL was
referred to DoT for their clearance. In DOT also, Assn pursued the
matter with Member(S) and DDG(Estt). We are extremely thankful to DIR(HR)
and GM(Estt) for settling the long pending issues of JTOs recruited in
2001, 2002, 2005, 2007 and 2008

JAC met CMD/directors of board of
BSNL.
JAC
had extensive discussions with CMD/directors of board of BSNL on the
issue of refund of 3G spectrum charges and non payment of BWA spectrum
fees. Very strong grounds were cited by JAC to demand BSNL not pay BWA
spectrum charges. JAC pleaded with BSNL management to take a very tough
position on these issues because of discriminatory attitude of the
government. CMD while giving a patient hearing remained non committal on
the issue of payment of BWA spectrum charges.
In
addition, other issues of payment of license fees on AGR by taking
revenues earned from non licensed activities into account and also
payment of higher usage charges for spectrum by BSNL were discussed and
JAC impressed upon BSNL management to make both these payments on the
lines of Private operators. CMD assured that BSNL management has already
decided to make both these payments as per the Judgments of TDSAT.
Procurement of GSM equipment to meet future expansion plans and focus on
other potential areas of telecom business was also discussed. JAC was
informed that adequate steps are being taken to take care of future
expansion needs in a planned manner and focus to take on strategic
potential areas of emerging telecom business.
Meeting with Director(HR):
GS along with both AGSs met
Director(HR) to discuss following issues. GM(Rectt.) and GM(P) were also
present.
1.
Holding of LDCE to SDE(T) on schedule:
Association pleaded with Dir(HRD) to go ahead with holding of LDCE on
4th July '10 since thousands of JTOs have availed leave for the last 2
to 3 months and organization also has made extensive arrangements for
holding the said examination. Association also pleaded with Dir(HR) to
try to protect the interest of all similarly placed JTOs who have not
obtained the judgment for provisional admission to appear in the said
examination. GM(Rect) and GM(P) who were also present assured that they
will try their best to appropriately defend the provisions of
eligibility envisaged in the existing RRs. Dir(HRD) while assuring to
explore all possible ways to conduct exam on schedule, however,
expressed certain practical difficulties to make arrangements for
holding examination for huge number of additional JTOs at such a short
notice. BSNL Management wants to maintain the sanctity of the said
examination, Director(HR) mentioned.
2.
Adhoc and regular DPCs to STS;
GM(P) informed that all
steps are being taken to issue the promotion orders to adhoc/regular STS
as soon as possible. While orders to adhoc STS will be issued as soon as
vigilance clearance sought from field units is received, action in
respect of completing regular promotion to STS is also being
simultaneously initiated.
CSs must ensure that
vigilance clearance for adhoc STS promotion and CRs for regular STS
promotion are sent at the earliest. CHQ is very closely monitoring
action of CSs on both these issues. Inaction and delay to send the
required information will delay both these DPCs and concerned CSs will
be entirely responsible for the delay in issuing promotion orders to
adhoc/regular STS. CSs should act on war footing basis and get fully
involved in sending VC/CRs. |

The
case filed by some SDEs to stay ongoing adhoc STS DPC in Hon'ble CAT
Banagalore came up for hearing on 18th June 2010 . Hon'ble CAT while
declining to stay the ongoing DPC , admitted the case and posted it for
1st JULY 2010. |

Do or die situation has descended.
DOT
has asked BSNL to pay Rs 8313.78 crores as spectrum charges for BWA
latest by 22nd June, 2010, in addition to Rs 10,186 crores
that it has already paid for 3G spectrum.
Does BSNL really need BWA spectrum to provide internet/ broadband
services when it has nearly 70% unutilized copper? Is it worth for a
Company reeling under severe financial crisis to invest Rs 8313 crores
on a business whose returns as of now are negative?
Private operators having bid for BWA spectrum for select
potential circles are not going to use it for providing Wimax services
but are to wait for a year or so for new upcoming technology Long term
evolution (LTE) to provide 4 G services on BWA spectrum once LTE is
marketed in India. Besides, private operators have already formed a
strong cartel to ensure that they do not compete with each other in
potential circles to protect their business interests and also save on
their investments on payment of spectrum charges. They have also closely
followed this strategy while auctioning of 3G spectrum. BSNL, on the
other hand, has paid Rs 10,186 crores, for Pan India, more than 60% of
what other leading operators like Airtel, Vodafone, Reliance etc., have
paid without giving it any opportunity to select Circles if its business
choice. In the same manner, Govt.., without offering BSNL any choice to
decide its select Circles, has asked it to arbitrarily pay Rs 8313
crores on BWA spectrum, more than 70% of what other leading operators
like Airtel, Vodafone, Reliance etc have paid for select Circles.
What is the way out?
BSNL should straightaway
surrender BWA spectrum even though it has invested little over 1200
crores to procure Wimax equipment which has neither so far nor is in
future going to yield any revenues. It is in the best business interests
of BSNL to lose 1200 crores rather than squander away Rs 8400 crores by
paying on BWA spectrum and completely exhaust the reserves of BSNL.
Will BSNL management do
it? No, no, no,
not at all. It needs a thoroughly professional and tough management full
of conviction, honesty and courage to confront administrative ministry
and comprehensively defeat its ulterior motives to land BSNL in
bankruptcy. We are not going to land in bankruptcy - we are almost
bankrupt with our reserves depleting very fast. In a day or two, CMD/BSNL
will hand over on a platter another Rs 8313 crores to DOT as BWA
spectrum charges, reducing our reserves from 36,000 crores to just about
10, 000 crores. It needs likes of late Sh.Subhir Raha, Chairman ONGC,
who defeated the efforts of bureaucrats and politicians to make ONGC
bankrupt. Our management is just nowhere even remotely near him.
Who has to save BSNL from total bankruptcy?
Each and every worker
of BSNL totally regardless of which Union/Association he or she belongs
to has to rise up in arms and hit back with greatest force to defeat
well planned conspiracy to sell BSNL to vested interests. We all
irrespective of where we stand have a fundamental responsibility to
safeguard our families and protect our beloved bread earner from total
disaster. We have nothing to lose. We have virtually lost everything.
So, why should we be scared of hitting out at the government with
tremendous and unparalleled courage and unwavering conviction? Why
should we create a painful and pathetic situation where we tell our
Children that we were cowards not to struggle and be able to protect our
jobs, Company and their future? Whether we succeed or not is an entirely
different matter - let us not helplessly watch losing our bread and
butter but give a lasting fight till our last breath that posterity
remembers as truly historical. This is our humble appeal to every one
whose livelihood and the future of family is dependent exclusively on
health of BSNL. All our internal scores we can settle once we primarily
emerge successful in protecting our beloved Company from getting sunk to
the bottom in the deep waters. Let us first create a situation where we
can subsequently settle our internal tussles. |

HINDU reports - 2G spectrum: removal of senior officials sought -
These officers cited as
chief architects of the mechanism for allocation of spectrum
Their continuance “makes a
mockery of the efforts to get to the crux of the matter”
“The very continuance of
these officers in the sensitive positions they held while finalising highly
controversial first-cum-first-served criteria for allocation raises very
fundamental and pertinent issue of the bona fides of the administrative
ministry of allowing the investigating agency to reach an impartial and
transparent conclusion.
“Besides, absence
of even a very preliminary action of not transferring the officers sounds
ridiculous and virtually makes a mockery of the efforts of Prime Minister
Manmohan Singh to get to the crux of the matter,” SNEA (I) general secretary
G.L. Jogi told The Hindu.

THE
HINDU reports - BSNL forced to pay more spectrum charges -
“It is a serious issue… while we are being
forced to pay despite financial difficulties, private operators are making
merry. We are writing to the Telecom Secretary to exempt us also from the
hike order or we, as principal stakeholders in the company, will move court
seeking relief and refund of the amount so far. If the department cannot
take legal action, we certainly can do so,” said Sanchar Nigam Executives
Association (India) general secretary G.L. Jogi.

1. Association writes to Hon'ble MOC,
Shri A.Raja
requesting him to immediately
disband committee under the Chairmanship of Member(T), Telecom
Commission to decide procurement of GSM equipment that BSNL needs
for expansion. Association pleads that BSNL board be given complete
freedom to decide commercial and business policies to allow it to
compete fierce competition.

2. Association writes to Secretary DOT,
Shri P.J.Thomas demanding to immediately transfer officers involved in
implementation of licensing policy of DOT for their discriminatory and highly prejudiced
stand to levy exorbitant licence/spectrum charges from BSNL, giving
tremendous relaxation to private operators. These officers are already
under cloud for being involved in finalising highly controversial
criteria of first cum first serve for allocation of 2G spectrum which is
being probed by CBI and against which a charge sheet has been filed.
Having developed unhloy nexus with private operators, these officers are
inflicting huge damage on the business interests of BSNL.

Pay
anomaly of JTO 2007 and 2008 batches:
GS along with AGS, Sebastin
met GM(Estt.) and
discussed the issue. Association pointed out that JTOs of 2007 & 2008 batches
were recruited
in the pre-revised pay scale of 9850- 250-14600. By provisionally
placing them in the E1 scale of 16400- 40500 , they are incurring a
monthly loss of Rs. 4 to 5 thousand which is totally unjust and in
contravention of the recruitment condition. To overcome this serious anomaly, GS convincingly pleaded for
fixing their pay in the pre - revised scale of 9850-14,600 to ensure
that they do not suffer huge monthly loss of Rs 4 to 5 thousand till
their new IDA pay scales are finalized. GM(Estt) was completely convinced
with our arguments and assured
us that he will immediately initiate appropriate action to fix JTOs of
2007-08 in the pre-revised IDA scale of 9850-14,600. We will closely
monitor the progress of the issue till it is resolved to our
satisfaction. |

What is the compulsion for the struggle
that JAC is constrained to launch from 14th June, 10?
Government’s sheer apathy, indifference and calculated moves of the
vested interests in DOT in not protecting the legitimate interests of
BSNL by forcing it to arbitrarily pay 3G spectrum charges amounting more
than Rs 10, 186.58 crores in sharp contrast to Rs 5731, 5054,
6499,2021.5864 and 5769 crores paid by Bharti, Vodafone, Aircel,
Reliance, Tata and Idea respectively and also more than 13000 crores as
spectrum charges for BWA so that BSNL lands in bankruptcy and is
eventually privatized.
While
BSNL is forced to pay 10, 186 crores for Pan India licence on Pan India
basis, without giving it an opportunity to select service areas of its
choice based on its commercial potential, Private operators were offered
complete choice to decide select service areas on the basis of their
commercial interests and thus have had to pay less than half of what
BSNL has been forced to pay by DOT. Not only that, huge and incredible
rural and social obligations of the government that BSNL has been
relentlessly meeting have been totally disregarded by the insensitive
bureaucracy in DOT.
It is
extremely important to mention here that New Telecom Policy -1999
clearly mentions that BSNL need not pay any entry fees for getting
cellular mobile services license bundled with 4.4 mhz having provision
to enhance it to 6.2 mhz. Even the full license fee paid by BSNL was
required to be reimbursed according to the provisions of New Telecom
Policy – 1999.
BSNL
Management’s strong and justified plea of completely exempting BSNL from
payment of 3G spectrum charges based on formidable grounds of policy and
commitments of the government from time to time and also the fact that
BSNL have had no choice to select Circles based on its commercial
decisions is being brushed aside by bureaucracy and vested interests in
DOT whose sole job and objective is to fully protect the interests of
the private operators.
BSNL
shall be within a couple of days forced by DOT to pay more than 13000
crores as spectrum charges for BWA auction for which presently is
continuing. BSNL does not need any BWA spectrum since it has already
more than adequate copper to provide reliable broadband services. There
is absolutely no justification for BSNL to hold on to BWA spectrum and
shell out more than Rs 13000 crores from its reserves for having met
social obligations of the government to provide broadband in remote
areas on BWA spectrum. Here also private operators are given exclusive
choice to decide their select service areas based on their commercial
interests whereas BSNL will be forced to pay on pan India basis without
giving it any opportunity to select its service areas.
Why all this is being done by bureaucracy and a couple of officers
having strong nexus with private operators and developed firm vested
interests?
The game
plan of bureaucracy and these vested interests officers in DOT dealing
with licensing policy is crystal clear. By forcing BSNL to pay 10186
crores for 3G spectrum and roughly 13000 crores on BWA spectrum, the
resources of BSNL will not only be exhausted but will be in negative.
Reserves, not profits, will be in negative, Company would be declared
bankrupt and serious efforts aimed at Privatization of this prestigious
national telecom Company will begin, and with that the objective of MNCs
and their henchmen in the government and the bureaucracy will be
achieved.
Can anyone in BSNL regardless of his affiliation remain a mute
spectator when all out and calibrated efforts are being made to make
BSNL bankrupt and finally sell it?
We should
all rise above all other considerations regardless of where we stand and
comprehensively defeat the diabolical designs of the vested interests
within and outside the government to sell this Company to MNCs in a
manner similar to VSNL. Calculated strategy and efforts have started to
sell BSNL by declaring it bankrupt and it all depends how much united we
remain at this crucial hour to defeat such sinister moves of the vested
interests. |

June,2010; Meeting with
Director(HR):
GS
along with AGS, Com Sebstian, had extensive discussions with Director(HR)
lasting about two hours to impress and request Director(HR) to initiate
all possible steps for issuing promotion orders from;
TES Gr
B to adhoc STS, B) Adoc STS to regular STS, and C) JTO to TES Gr B.
Director(HRD), after receiving detailed inputs to expedite issuing of
promotion orders in respect of all the three DPCs, assured us that he
will personally monitor the progress of all the three DPCs and ensure
their timely completion and issuing of orders as early as possible.
Director(HR) gave very specific and elaborate instructions to GM(P) who
was also present in the meeting regarding completing all the three DPCs
and issuing of the promotion orders at the earliest.
Specific instructions were also given to GM(P) by Director(HR) on
holding of LDCE without any hurdles on 4th July,10 by
remaining alert and initiating all possible actions to ensure that
holding of the said examination against about 5000 TES Gr B vacancies is
not held up on any flimsy grounds. Director(HR) firmly turned down our
request of abolishing negative marking provision in the LDCE since he
felt that it would not be appropriate to dilute the quality of the
competitive examination by compromising on some of its basic features
aimed at making the examination qualitative. Despite our consistent
pleading, Director(HR) remained unconvinced and asked us not to press
for it.
On the
issue of payment of additional 9.8% IDA, Director(HR) assured that the
committee already set up to examine and give suitable recommendations on
how to resolve this issue is likely to submit its report very shortly
after which BSNL Management will take appropriate decision.
We are
extremely thankful to Director (HR) for his kind and very assertive
intervention in trying to resolve the issue of transfer of DS/Bharatpur(Rajasthan).

writes to DIR (HR) on the pay anomaly of JTO 2007 and 2008 batches:
JTOs of 2007 & 2008 batch recruited
in the pay scale of
9850- 250-14600.
Provisionally
they were placed in the E1 scale of 16400- 40500 resulting a pay loss of
Rs. 4000 per month which is against the rect conditions. Some circles
have fixed their pay in the pre-revised scales to avoid the anomaly.
To overcome this serious anomaly SNEA (I) demands
1) fixing their pay in the pre - revised scale to at least protect their
pay and 2) standard pay scales E2 & E3 in place of E1A & E2A are to be
processed and sent to DOT.

Joint Action Committee (JAC) Meeting on
09.06.2010: JAC
leaders met on 09.06.2010 and discussed the status of demands /
assurances given by Hon'ble MoC&IT in the meeting held on 20.04.2010, on
the first day of Indefinite Strike. JAC after detailed discussions come
to the conclusion that there is no seriousness on the part of DOT/BSNL
for the redressal of the JAC demands and on the assurances given by
Hon'ble MoC&IT. Even after a lapse of 1 month and 20 days, the Cabinet
Note on
ITS officers' absorption
and
IDA pension revision
issues has not been prepared and circulated to nodal
ministries, whereas the assurance was given that within one month period
the Cabinet Note on both the issues will be sent for inter-ministerial
circulation and thereafter within 2-3 months Cabinet approval will be
taken.
JAC earlier demanded
the waival of 3G and WiMAX spectrum charges in view of the financial
condition and requested CMD, BSNL to take up the matter with Govt.
Instead of taking up the matter with Govt, BSNL Management has promptly
paid 3G spectrum
charges of Rs. 10,186.56 Cr to DOT
from the cash
reserves without showing any
resistance or a request for deferred payment in view of the continuous
decline of BSNL's profit. When WiMAX spectrum auction is over
within a few days, BSNL has to pay another 9000 Cr and by that BSNLs
cash reserve will exhaust. BSNL Management ignoring the demand of
JAC and without bothering the BSNL's financial health is trying to
exhaust BSNLs cash
reserves. This is a very serious
development that will definitely affect all future developmental plans
of BSNL including procurement of GSM equipments. It was seriously viewed
by JAC and demanded that 3G spectrum charges should immediately be
refunded to BSNL and consider deferred payment for a period of 20 years
(license period) on yearly basis for 3G and WiMAX spectrum charges.
The assurance given by
Hon'ble MoC&IT and CMD, BSNL for the procurement of
10 million GSM lines immediately for
Eastern & Northern Zones has been reduced to 5.5 million GSM lines by
BSNL Board on the intervention of DOT and that will adversely affect the
growth of BSNL and its viability.
The
78.2% IDA neutralisation instead of 68.8%
as per DPE OM dated 02.04.2009 has not been implemented by BSNL
Management, despite the assurance given by the Hon'ble MoC&IT.
JAC demanded that
Govt. of India should direct all Central / State Govt, departments and
PSUs to avail telecom services from BSNL / MTNL only and also
should allow BSNL to procure equipments on competitive rates from any
supplier / vendor on international security standards irrespective of
technology.
On the
above issues, JAC unanimously decided to resort immediate trade union
action programmes i.e.
Massive Demonstration on
Monday, 14th June 2010
during Lunch / Closing hours and
Mass Dharna for one day on
Wednesday, 16th June 2010
at BSNL Corporate Office, all Circle / SSA HQs. All the Circle / Branch
Secretaries are requested to ensure successful implementation of
Agitation Programmes. Future course of action will be decided by JAC
shortly. |

incomplete. Category wise vacancy position has to
be declared before holding of LDCE on 4th July, 10. Otherwise both LDCE
and seniority cum fitness DPC from JTO to SDE shall be delayed. CSs has
to take full responsibility on the delay. They should ensure that the information reaches BSNLCO
positively by this weekend. |

DEs having below bench mark entries in the ACR was intimated to CGMs by BSNLCO on 21st May for intimation and necessary action (not uploaded in
the intranet). CSs kindly ensure that the entries
are communicated to the officials and the corrected ACR reaches BSNLCO
at the earliest. |

2nd June, 10. Meeting with Director(HRD)
GS had extensive discussions
regarding expeditious completion of DPCs from JTO to TES GrB , TES GR B
to adhoc STS and adhoc STS to regular STS were held with Director(HRD)
who assured that all possible steps are being initiated to complete all
the DPC’s as early as possible and further mentioned that he is very
closely monitoring personally the progress of these DPC’s.
GS had also elaborate
discussion with Director(HRD) regarding new IDA pay scales of JTOs and
SDEs, strongly pleading with him that BSNL management needs to relook at
the whose issue and seriously consider processing fresh proposal of
standard pay scales of E2 and E3 for JTOs and SDEs in view of high
quality of JTOs getting inducted in the Organization. There is
absolutely no rationale in pursuing mid scales E1A and E2A for JTOs and
SDEs. Very shortly, we are submitting a comprehensive note bringing out
very strong justification in demanding finalization of standard pay
scales of E2 and E3 pay for JTOs and SDEs and thereafter we shall
relentlessly pursue the matter.
Meeting with GM(P)
Roster in respect of SC/ST Comrades:
GS
had a very detailed discussion with GM(P) regarding observing of roster
in regard to SC/ST for promotion from JTO to SDE and DE to STS. GS
clearly impressed upon GM(P) to maintain total transparency in respect
of maintaining roster in accordance to existing provisions. GM(P)
mentioned that roster is being finalized by collecting data from all the
field units and DPC from JTO to TES Gr B shall commence only after
finalization of roster before 4th July, 10 when competitive examination
from JTO to TES Gr B is to be held so that vacancy position in
accordance to roster is declared before holding of competitive
examination. Thus vacancy position category wise against competitive
quota would be declared well before the commencement of the examination
on 4th July,2010.
GS pleaded with GM(P)
to upload roster once finalized on BSNL site so that SC/ST Comrades have
total access to it and are in a position to point out any discrepancies
that they find. GM(P) assured to do this after finalization of the
roster. However, we fully assure our SC/ST Comrades that DPC from JTO to
TES Gr B shall commence only after finalization of the roster and
Association will very closely monitor this activity and fully ensure
that SC/ST Comrades are not under any circumstances deprived of their
legitimate rights since this Association has all along stood firmly
committed to protecting the legitimate interests of our SC/ST Comrades
and shall never let any kind of injustice to be met to our SC/ST
friends. Let them remain fully assured of this and not entertain any
kind of suspicion on this account. We shall very shortly update the
complete details of SC/ST quota to be filled in the ensuing DPC from TES
Gr B to adhoc STS and adhoc STS to regular STS according to the existing
provisions in our site. We shall also be very closely monitoring this
while DPCs from TES Gr B to adhoc STS and adhoc STS to regular STS
commence till they are completed and ensure that stipulated provisions
to fill up SC/ST vacancies are fully complied with.
GS also had detailed
discussion with GM(P) regarding completing DPCs from TES Gr B to adhoc
STS, Adhoc STS to regular ST and JTO to TES Gr B as early as possible.
An appeal to our SC/ST Comrades:
ven though needless to mention, yet, in view of the
recent developments, we want to reiterate that this Association has
consistently protected the legitimate interests of our SC/ST Comrades in
terms of ensuring that they are not deprived of their legitimate quota
for promotion from JTO to TES Gr B and TES Gr B to adhoc STS in
accordance to the prevailing provisions of the government. In fact, it
is the bounden duty and fundamental responsibility of this Association
to fully ensure that injustice of any kind whatsoever is not met to our
SC/ST Comrades. We would like to fully reassure all of them that this
Association shall never remain a silent spectator to any kind of
discrimination being met out to our SC/ST Comrades.
Break
up of DPC conducted recently from adhoc STS to regular STS;
About 301 adhoc STS were considered for regular
promotion to STS about six months before, out of which DPC found only
281 fit for regular STS. The break up is as under:
No of vacancies for which DPC was held: 301.
Adhoc STS found fit for regular STS promotion: 281.
No of OC candidates: 224.
No of SC candidates: 50.
No of ST candidates: 7 (only 7 ST candidates were
available.)
Why DPC was conducted only for 301 vacancies? Because
301 adhoc STS were above dispute zone (270 competitive adhoc STS), that
is why the number of vacancies had to be restricted to 301 above the
starting point of dispute zone.

That
means in the ensuing DPC for regular promotion from adhoc STS to regular
STS against remaining 2450 vacancies (2731-281), number of SC and ST to
be regularized would be 359 and 197 respectively i.e total SC and ST
regularized out of total 2731 vacancies would be 409 and 204
respectively. Association would fully ensure that 409 and 204 vacancies
are filled up by SC and ST Comrades respectively.
Why
Association wanted stay to be lifted in J&K High Court?
Because Association did not want to delay
regularization of adhoc STS to regular STS for that would also mean
delaying the promotion of 613 SC/ST Comrades and a large number of them
are getting retired every month.Thus we make a dispassionate appeal to
our SC/ST Comrades to repose full confidence in this Association for
protecting their legitimate rights and the Association will never be
found wanting in this regard. We further appeal our SC/ST Comrades not
to waste their precious time and money in filing Court cases in
Tribunals/Courts etc. because this Association will remain fully
vigilant to safeguard their legitimate interests when DPC from TES Gr B
to adhoc STS and from adhoc STS to regular STS commences till it is
completed. However, if any feedback is to be given regarding
finalization of roster position strictly in accordance to rules of DOP &
Trg, it will be welcome since the same shall be taken up with BSNL
Management on top most priority. DPC from JTO to TES Gr B shall start
only after finalization of roster, and category wise vacancies for both
competitive and seniority cum fitness quotas shall be declared well
before holding of competitive examination on 4th July,2010.

moves by deeply entrenched vested interests to derail revival plans
aimed at pulling BSNL out of serious crisis – Pitroda panel
recommendations expectedly getting buried for all times to come.

District conference of Agra
Telecom District was held on 30th May '2010. The conference was attended
by Com. GS, Com. Khan , Com. B.C.Mishra, Com. Sanjeev Sharma C S,
UP(W) Circle. Shri H.S.Sharma, GMTD Agra was also present on the
occasion and stressed on the need for better QOS, meeting total
excellence in execution of work, proper use of real assets and total
development of Agra Telecom District. GS in his speech stressed on the
fact that now there is an urgent need for some drastic measures to be
undertaken in order to ensure that BSNL progresses. Many of the reforms
as suggested by Sam Pitroda are good for the organization and ways
should be explored for speedy implementation of these reforms. The same
age old and stale setup can't bring about sea change in the working of
organization. Matters like need of E2, E3 Scales for JTO/SDE, First TBP
in four years, EPF issues were also raised and discussed in GS address.
Com. Shiv
Narayan, Com. R.P.Sharma and Com. Malkit Singh were elected as
District President, Secretary and Treasurer for the new term. Four BSNL
recruitee JTOs were also elected as office bearers in the newly elected
District body. |
