SEPTEMBER 2009 EVENTS 

29th Sept 2009Comrades, get immediately ready for an All India Programme of most militant form of sustained organizational action to defeat the sinister designs of BSNL management and bureaucracy of DoT to inflict irreparable and irreversible damage on BSNL by calling for volunteers from Indian P & T Accounts and Finance officers (Class I services) to be sent on deemed deputation to BSNL/MTNL.

We are at a loss to understand how this letter calling for volunteers from DoT on deemed deputation to BSNL/MTNL has been issued by DoT when the Union Cabinet has repeatedly taken a conscious and clear decision not to allow anyone from DoT to BSNL/MTNL on deemed deputation.

This conspiracy between vested interests in the bureaucracy of DoT and BSNL management  has not only to be exposed but defeated lock, stock and barrel.

What we fail to understand is how a very senior officer of BSNL management from Finance wing had requisitioned for sending some officers from Indian P & T Accounts and Finance to BSNL on deemed deputation. But the most pertinent question that arises is how this decision of  Ex- Dir (F), BSNL was concurred to by CMD, BSNL and how the proposal was finally approved by Member (F) , DOT and Secretary, DoT in complete contravention of the decision of the Union Cabinet turning down the proposal of deemed deputation of anyone from DoT to BSNL/MTNL.

Get ready for a do or die agitation to defeat the conspiracy of vested interests to inflict irreparable damage on  BSNL  by allowing deemed deputation of class I officers from DOT to BSNL.

 
29th Sept 2009  Meeting with Director(HRD):  

The Association was called for a discussion on the issue of revisiting 30% fixation granted on the new IDA scales in accordance to the orders of DPE. GS and AGS, Com. A. Khan, expressed opinion on the said issue in very clear and unambiguous terms. Under no circumstances and in no situation can this Association even remotely reconcile to the suggestion of BSNL Management for reconsideration of the fixation criterion already decided and implemented. Any step in the direction of reducing the existing fixation on IDA scales will result in instantaneous industrial unrest of the worst kind, we categorically apprised Director(HRD), and requested him to convey the opinion of our Association to BSNL Board on the same lines. Legitimate fixation of pay in conformity with the orders of the govt. cannot be fiddled with by BSNL/Board and any attempt in the direction of diluting the fixation already decided will be met with stiffest resistance from our Association. Such arbitrary and authoritarian moves of the Management shall be squarely defeated by us, we are completely confident, for the simple reason that such decisions are not only indiscreet but a clear infringement on our legitimate rights and violative of the decisions of the govt. We further requested Director(HRD) not to act in a manner that will adversely and irreversibly affect the ongoing developmental activities in the organization.       

25th Sept 2009We have been advised by our Legal Council that all the executives, regardless of  restrictions imposed in terms of age and qualification contained in the provisions of recently notified MT RRs, should submit the application for appearing in the internal Competitive examination for recruitment of (250) MTs. We appeal to all our members to submit their application immediately through proper channel for appearing in the said exam, completely ignoring the restriction of age and qualification.

23 rd Sept 2009XXVIII Circle conference of Bihar Circle at Patna on 16th/17th Sept.,09:

The conference was held in a colourful manner, particularly the open session on 17th Sept. was extremely absorbing and was attended by about 500 Comrades. The open session was addressed by Sh. S.C.Mishra, CGM/Bihar, Sh R.P.Singh, PGM/Patna, GS, Com Madhusudan, CHQ Vice president, Com Rithesh Kumar, CS/Bihar , and CSs of ITSA, AIGETOA, BSNL EU, NFTE, and FNTO. Nearly 12 GMs from ETR, ETP, Finance, Civil and Electrical wing also attended the open session. Bihar Telecom circle is steadily registering signs of positive growth, CGM/Bihar informed the gathering. He further expressed the confidence and optimism that the growth rate is expected to stimulate further in the days to come. Tele-density and Market Share as on 31.08.2009.

During August 2009, 15.01 million telephone connections has been provided in the country taking the total telephone connections in the country 493.65 million as on 31.08.09.  

(1)     BSNL has added 12.21 lakh connections during the month of August 2009.  This works out to 8.14% of the total connection added in the country during the month of August 2009.

(2)     BSNL is at 2nd position as an operator with Market share of 17.38%.  BSNL market share has decreased by 0.29% during the month of August 2009 and during 2009-10 (upto 31.08.2009) by 1.60%.

(3)     The overall tele-density in the country is over 42.00% with Chennai License area topping at 113.61% and Bihar License area lowest at 21.95%.

(4)      BSNL now holds 1st position as an operator with total number of telephone connections in 5 license areas viz. Haryana, Himachal Pradesh, Kerala, Punjab & UP(E) Circles. 

(5)      BSNL has No.2 position in total number of mobile connections in 4 License areas viz. Haryana, Himachal Pradesh, Orissa and Punjab Circles.<<Letter>>   <<Annexure>>

Conduction of DPC to promote 1999 batch JAOs to the Grade of AAO: GS along with AGSs met ED(Finance) and discussed the issue. We requested to conduct the DPC by BSNL itself as directed by DoT in its letter dated 11.09.2009. The JAOs joined on12.05.2000, got absorbed in BSNL w.e.f 01.10.2000 and due for promotion to AAO grade in the 01.01.2004 DPC which was not conducted by either DoT or BSNL so far. BSNL declared AAO as a wasting cadre on 12.04.2004 and BSNL doesnot have AAO RR which delayed the process. ED(F) assured positive action.

18th Sept 2009MANAGEMENT TRAINEE RECRUITMENT: <<Letter>>

United Forum of BSNL Executives' Association writes to CMD, BSNL for the modification of provisions of MT RR notified on 01.09.2009 which are discriminatory and against natural justice. UF clearly told the Management that the notification not only discriminates and denies the really meritorious, but is also violative of the DOP & Trg guidelines and various Supreme Court Judgments as it will lead to the creation of "a class with in a class". UF demanded the internal fast track promotion is to be carried out without discriminations of qualifications and age, otherwise we will be unwillingly constrained to resort to all actions including agitational and legal actions to ensure justice prevails.

15th Sept 2009 CEC of Chattisgarh Circle:

CEC of Chattisgarh Circle was held at Raipur on 11th of September 2009 and was attended by all the representatives of various districts of Circle. In the evening of 11th a well organised open session was held and the topic of the open session was   'Revenue loss in Chattisgarh Circle and it's reasons'. CGMT Shri Ram  Yagya was the chief guest of the function and was accompanied by GM(Mobile) Shri R. K. Tyagi and DGM(Project) and all of them aired their views on the subject.  Com. A. A. Khan AGS, Com. Harsh Kaul Jt. Secy(C), Com. K. P. Naidu Circle Secretary & Com. S. K. Agarwal CWC member spoke extensively on the subject. CGM was also apprised of the local problems faced by the comrades of Chattisgarh Circle. The meeting was chaired by Com. Nag Circle President Chattisgarh Circle.Vote of thanks was given by Com. P. L. Mehra, District secretary, Raipur.

Competitive quota promotions in the Civil Wing:

Association met CLO Shri Prem Raj on the issue of Competitive quota promotions for our comrades of the Civil Wing. We discussed the issue threadbare. Later on it was assured by the CLO that the issue will be examined in entirety and then the necessary opinion will be given in file.

14th Sept 2009GS write to DIR(Enterprises) regarding certain clauses / provisions in the MLLN tender that are quite likely to jeopardize the interests of BSNL and promote and protect the interests of the vendor. >>>>>

11th Sept 2009Meeting with DIR(HRD), BSNL:                     GS, AGS Com. K. Sebastin and Jt Sec (North) Com. Inderjith Singh met DIR(HRD) and discussed the MT R/R and the proposed MT recruitment. GM(Pers) also present. We clearly told the Management that the age and educational qualification mentioned in the MT R/R for internal candidates is in clear violation of orders of DoP&Trg, regulating the provisions of the internal competitive examination. 3000 to 4000 Engineering Graduates from premier institutions such as Regional Engineering Colleges (NITs) and Govt. Engg colleges (some of them having M Tech) recruited by DoT in the year 1994 and prior to that and having minimum 12 years of experience in Telecom operations are not allowed to compete in the internal competitive examination. In addition to this, thousands of Post Graduates and Graduates with minimum first class (even some of them are University rank holders) and having vast experience in Telecom operations also deprived the opportunity. Some of them having MBA/MCA degree also. Some JTOs quit their job and joined BSNL in 2001 year rect. also not eligible because of the age limit. GM(Pers) informed that already relaxation of 6 years is given to the internal candidates as 5 years relaxation given by UPSC. We clearly told that this relaxation of 6 years is for External quota and not for Internal quota. For Intl quota, there should not be any age or qualification bar. If the Management  not considering this, we fear that the entire rect process may face legal hurdle and the recruitment will be delayed for years together. Further we told that we will submit a comprehensive note on Monday and management has to reconsider the eligibility conditions of Intl candidates based on that. We will further discuss the matter with CMD/DIR(HRD), BSNL next week.

Clarification on Time Bound Promotion Policy for Executives on revised and provisional IDA pay scales for JTO/JAO/SDE/AO: The TBP promotion due on or after 01.01.2007 for JTO/JAO to SDE/AO grade has to be kept in abeyance till the notification of final pay scales. The TBP due upto 31.12.2006 will be assessed on the basis of pre-revised scales. Already settled cases on pre-revised scales and due on or after 01.01.2007 has to be reviewed on notification of revised new pay scales. <<Clarification>>

11th Sept 2009 RECRUITMENT OF MANAGEMENT TRAINEES:

Association is all along pleading with the Management that there should not be any AGE / QUALIFICATION BAR for the rect. of Management Trainees through internal competitive examination. Association elaborately submitted its views to the committee constituted under the chairmanship of PGM (IR) to examine the issue of relaxation in age and qualification for MT rect through internal competitive examination. Association strongly pleaded for allowing BSc, 1st class (Educational qualification for Outside rect of JTOs), with no age bar, to appear for the internal competitive examination.   The management has ignored the views of the Association in contravention of the orders of DoP&Trg, regulating the provisions of the internal competitive examination. Association is determined to end this discrimination and going to take up the issue with the Management once again. Managements failure to respond to our plea of conduction of internal competitive examination in accordance to DoP&Trg rules allowing Executives to appear in the internal competitive examination with no age bar and Educational qualifications of BSc (First Class), shall force the Association to seek appropriate legal recourse. 

10th Sept 2009 MT RECRUITMENT: MOST OF THE TALENTED AND EXPERIENCED EXECUTIVES IN BSNL ARE DELIBERATELY BARRED IN THE NAME OF AGE & QUALIFICATION AS DONE IN THE CASE OF DGM RECT. ASSOCIATION IS ALL ALONG PLEADING WITH THE MANAGEMENT THAT AS PER DoP&T GUIDELINES THERE SHOULD NOT BE ANY AGE / QUALIFICATION BAR FOR THE INTERNAL CANDIDATES. WE ARE STRONGLY TAKING UP THE WHOLE ISSUE WITH CMD/DIR(HRD), BSNL. ASSOCIATION WILL TAKE ALL STEPS INCLUDING ORGANISATIONAL AND LEGAL ACTION FOR SETTLING THIS ISSUE.

JTO(T) to SDE(T) promotion under seniority quota: Promotion orders for 11 missing cases issued<<order>>

Growth of Mobile connections for the last 5 months is only 50% of the target ie. 5.3 million against the target of 10.675 million-- HP/HR/KRL/OR Circles exceeded the target but Bihar/WB/RAJ/J&K  Circles are far below the target. CMD mentions that while 60% of the Private operators connections are coming from rural areas, BSNL fails to add new connections from rural areas where BSNL having strong presence. Resolution of Consumer disputes through arbitration: All Telecom Disputes including billing has to be settled through arbitration as per section 7-B of Indian Telegraph Act and consumer courts has no jurisdiction. BSNL endorses the Hon. Supreme Court order >>>>>

Management Committee of BSNL Board approved the proposal for reduction of qualifying service from 10 years to 7 years to appear in the LDCE for promotion to JTO(T) R/R has to be amended accordingly. Earlier the MC has rejected the same proposal. Again as per the agreement in the National Council, the proposal has moved.

ACP Committee has submitted its report to PGM(BW) and the same will be forwarded to competent authority with their comments.

Abolition of Circle Telecom Boards -- clarification >>>>

07th Sept 2009LDCE for JTO(T) to SDE(T): BSNL Board approved the scheme of examination for LDCE. Hereafter there will be no descriptive type questions and only OMR based objective type questions will be there. The syllabus will be the same. The proposal for notification of LDCE for about 4400 SDE posts (including carried over LDCE quota) for the vacancy years 2006-07 and 2007-08 send to DE section. SNEA(India) succeeded in getting approval of change of scheme and notification even though one Association tried to stop it and deny the promotions to 4400 JTOs. Last time also they tried to stop the LDCE by different court cases, but they could not succeed because of the tough stand taken by SNEA (India). For the first time in the history of DoT/BSNL, hundreds of JTOs who had just completed 3 years of service got promotion to SDE(T) because of SNEA (India). JTOs of 1992 (promoted in seniority quota for 2006-07 & 2007-08) to 2002 rect. year are eligible to apply. eg. for the vacancy year 2006-07 one must complete three years of service as on 1st July 2006.

The SLP filed by BSNL in Hon. Supreme Court regarding Seniority and Para 206 came up for hearing today and the same admitted.

AGSs met GM (Pers) and discussed

a) Regularization of Adhoc DE: GM(Pers) informed that almost DPC is over and now about 40 missing cases are there and most of them from ETR, Bihar and BSNL CO. He is in constant touch with the CGMs and GMs to ensure that DPC is over and promotion orders are issued in time. Management is working to complete the regularization process simultaneously in all disciplines.

b) DPC from SDE(T) to DE Adhoc:  We expressed serious concern over the delay in completing the DPC from SDE(T) to DE Adhoc as so many Executives are retiring every month. Filing of reply to Hon. J&K High Court against stay order is  getting delayed . GM(Pers) informed that the reply has been prepared and send to CGM J&K. As soon as the stay is vacated, single promotion order will be issued to fill up all vacant DEs posts as DPC work was in advanced stage.

c) promotion of 63 JTO(C) to SDE(C) in the LDCE: GM(P) informed that the fie has reached his office and same send to CLO for comments. We expressed our serious concern over the delay in issuing the promotion orders. GM(P) assured to expedite the process.

d) pending request transfer cases of SDEs/DEs : We requested to consider all pending transfer cases of SDEs/ DEs pursued by the Association. We informed that all the cases are put up from the section long back but the same is not yet cleared even though GM(P) assured last week that it will be cleared immediately.

05th Sept 2009General Secretary’s tour of Tamil Nadu -  General Secretary attended the Circle Executive Committee meeting of SNEA (India), Tamil Nadu Circle at Coimbatore on 3rd and 4th September, 2009 and had interactions with members.

      An open session was held on 03rd Sept. Sri. D. Varadarajan CGMT, TN Circle and Sri. P. T. Mathew, PGMT Coimbatore SSA addressed the open session. Both CGMT and PGMT stressed the need for change in attitude and work culture. GS in his address focused on the growth and financial viability of our beloved company, BSNL and endorsed the views of CGMT and PGMT. Veteran Leader Com. W. Seshagiri Rao, Jt. Sec(S) Com. R. Rajan, CHQ Treasurer Com. H. Muthu and C/P Com. Sundarakrishnan addressed the open session. C/S Com. R. Ashokan delivered the Key note Address. Office bearers and activists from neighboring Erode, Dharmapuri and Salem SSAs also attended the meeting.

      GS concentrated his address to issues related to the growth and profitability of BSNL. He also highlighted the crucial decisions of CWC held at Shillong. The long-drawn out battle by the Association to bring out a greatly favourable  BSNL MS R/R, breaking open the more than three decade old bottle neck, the  DGM and MT rectt, pay scales of JTOs and SDEs, merger of 9.4% of IDA, perks etc. also figured in his address. Erosion of profits of BSNL is a serious concern, which will eventually reflect upon the paying capacity of the Company. Any further dent in the profits will make it difficult to retain even the present pay structure. On IPO and ITS absorption issues, we are pursuing the matter in the Joint Forum. After the address, GS interacted with the members for over an hour on various issues such as profitability of BSNL, IPO, ITS absorption, BSNL MS R/R, DGM and MT rect, pay scales of JTOs and SDEs, merger of 9.4% of IDA, perks, full pension option for EPF etc. Photos <<1>> <<2>> <<3>> <<4>> <<5>> <<6>> <<7>> <<8>>              

05th Sept 2009Tenure Transfer of SDEs issued <<Order>>
Revised MT RR: Salient features:

1.       Pay Scale : E3 scale: Rs. 24,900 – 50,500/-

2.      No of posts: MTs shall be recruited against 50% of equivalent STS level posts as decided by BSNL Management for each year. Initial strength shall be 600. (MT- Operations – 500, MT – Accts & Finance – 100)

3.      Ratio of posts: 50% of posts will be open for both Extl and Intl candidates and will be filled based on merit. Remaining 50% posts will be reserved for Intl candidates only.

4.      Mode of recruitment: The selection shall be based on the final merit list created based on the combined score from assessment process (75%)  + Group discussion (12.5%) + Personnel interview (12.5%). 50% of MT posts shall be filled regardless of Extl or Intl candidates. Remaining 50% of MT posts will be reserved for Intl candidates.

5.      Recruitment year: Rect. Year shall be the year of declaration of result.

6.      Probation – cum – training: 52 weeks including the job on training.

7.      Career progression: Appointment as Manager (MT) [Sr. SDE grade, E3 scale] on successful probation cum training. To be promoted as Asst. General Manager (E4 scale) on 2 years working as Manager (MT). Further promotion will be as per BSNL MS R/R, 2009.

8.      Age limit. MT(Extl) – 30 years, MT (Intl) – 36 years as on 01st August of the year of Examination. (Relaxable  in the case of reserved category as per Govt. rules)

9.      Eligibility for Intl candidates: Regular BSNL employee at or above JTO/JAO equivalent level and below MT level with 4 years experience in BSNL and possessing the required eligibility conditions.

 Changes made in the earlier MT R/R: 

1)      Intl candidates are allowed to compete for Extl quota also. So Intl candidates can occupy even 100% of MT posts.

2)      The unfilled Intl quota will not be diverted to Extl quota.

3)      B Tech / BE Electrical also included.

4)      Experience in JTO / JAO cadre onwards only will be considered. Earlier 4 years experience in BSNL only was required.

Consumer court has no jurisdiction over telecom disputes with consumers. --- The Supreme Court on Tuesday ended the jurisdiction of consumer courts to entertain disputes relating to telecom services. It said from now on, these disputes would be resolved through arbitration provided under Section 7B of the Indian Telegraph Act, 1885.<<News>>

01st Sept 2009Payment of PLI for 2008-09: DIR(HRD) called the two recognized Executive's Associations in BSNL, SNEA(I) and AIBSNLEA to discuss payment of PLI for the year 2008-09. Management told that this year employees may agree for not to take Bonus as the Financial position is bad. Even if PLI has to be paid, as per DPE guidelines 5% of the distributable profit can be paid (ie. 5% of Rs. 575 crores which comes to Rs. 28 crore). ie. Rs. 28 crores can be distributed among 55,000 Executives and the amount comes to Rs. 5000 which is 50% of last years minimum PLI.

Payment of 2nd installment (60%) of Pay arrears: We requested the early implementation of Dept. of Expenditure order dated 25.08.2009 and endorsed by DoT to BSNL on account of Pay revision. DIR (HRD) assured early action.
